The girl, a widow in need of a caregiver, will mark her 100th birthday in April. But even these days, as the corona plague continues to spread, she is forced to fight bureaucracy to get help.

About two months ago her caregiver left after being with her for five years, and her daughters were able after efforts to find another caregiver for her.

However, the Population and Immigration Authority flatly rejected the application to extend her visa because she has been in the country for more than eight years.

The appeal filed with the Court of Appeals was also dismissed.

The girl was independent until about five years ago, when she fell and was injured.

Since then she has been suffering from physical difficulties and needs a close caregiver.

Her daughter Sharon says that with the announcement of the caregiver's departure, she and her sister turned to nursing companies in an attempt to find a new caregiver for the artist - something that turned out to be particularly complex for them.

"We have been told in companies that there is a shortage of caregivers because many have left because of the corona, and my mother is also 99 so even if there is someone relevant, no one wants to come work for her," she describes, explaining that workers prefer younger patients to stay for a long time. .

Finally, they located Maria, who worked with an acquaintance of the deceased family, but since she has been in the country for more than 63 months, she required special approval.

The Entry into Israel Law stipulates that the visa of a foreign nursing worker may not be extended beyond 63 months from the date of his entry, unless it is a continuation of employment with a patient he has treated for at least one year, in order to prevent settlement in Israel.

However, exceptional cases have also been identified in which a visa extension can be requested.

The Minister of the Interior may extend the visa to the employee "for special and exceptional humanitarian reasons that exist in the nursing patient, and are related to the complexity or uniqueness of the nursing care required of him or other personal circumstances."

This is in accordance with the recommendation of the Humanitarian Committee.

However, the threshold conditions stipulate in the law, including that the committee will consider the application only if less than eight years have passed since the employee's first entry into Israel, and no previous application by the Minister of the Interior to extend licenses for humanitarian reasons before.

Maria entered Israel more than eight years ago, so the application to extend her visa was rejected outright.

"Those who are willing to come and work for such elderly people are those who have no choice but to ask for a special permit," says Sharon.

"And my mom is 99. She's in a crazy trap."

"When the caregiver announced that she was leaving and we started the race to find someone, the feeling was of helplessness and an illogical trap. It is a very difficult feeling," Sharon added, "She has more me and my sister, that we express ourselves and can help and know who to turn to, but there are many elderly "In general, there are those who will help them. And there are elderly people who have families who do not have the ability to help as much. This is an intolerable situation. People who are here in the place of the state, and have worked and contributed and reach the last line and are abandoned."

"Corona crisis has created a deep shock among the elderly and their families" (Photo: Nir Landau, Walla!)

The appeal, filed through Advocate Tomer Warsaw, argued that the law "leaves the appellant - and other patients with similar circumstances - in a broken trough, when they cannot locate an alternative caregiver, and on the other hand their request to extend the caregiver of the caregiver they succeeded in can not be approved. It was also stated that in 2016 and 2018 the Minister of the Interior gave sweeping approvals due to the large number of requests and congestion. The

appeal also states that "If procedural taste was a sufficient reason for this decision in the past, then due to a slight global crisis, the State of Israel did not miss." "

Last month, Dayan Hanania Guggenheim rejected the appeal on the grounds that the request does not meet the threshold and that the Minister and the Committee have no authority to discuss it." In such requests. Now the girl is expected to file an appeal to the district court. "It's also a legal battle that costs money.

Nor is it fair to my mother.

She is in an amazing cognitive state and has a quality of life despite the not-so-simple physical state.

If it were not for me and my sister, there would be no one to fight for her.

She certainly could not take care of herself, "says her daughter, noting that the postponement also made it difficult to receive a nursing allowance during this period.

As a result of the threshold conditions, the state does not always reach the quota set for approvals in exceptional cases - 1,500. In 2020, 1,228 applications were approved by September that year, 855 applications Rejected outright and 141 after a discussion in committee. The Population Authority said that last year almost the entire quota was approved. In 2019, only 964 applications were approved, 772 were rejected outright and 474 were rejected after discussion.

Thousands of therapists are ready to stay in Israel - and are required to leave

Attorney Warsaw

Advocate Warsaw, who owns an office in the field of immigration and status in Israel that has received repeated inquiries on the subject from families of the elderly, says that the law is especially problematic at this time and that a temporary provision should be enacted that will ease patients and eliminate threshold conditions. Based on the patient's condition, without additional criteria.

According to data from the Population and Immigration Authority published about three months ago, there are about 55,000 foreign nursing workers with visas and about 13,000 without a permit. "The corona crisis has created a deep shock among the elderly and their families. "They have found themselves in isolation from their loved ones, and they rely even more on the dedicated services of close caregivers," says Warsaw. therapists ".

" It is becoming clear that the rising demand also meet supply which is right at your fingertips - and avoided only because of the helplessness of the authorities ", Warsaw added," It turns out that the country thousands of caregivers who entered Israel legally and visas, worked here with great success, recognize the Language and mentality

"And they are ready to stay here and continue to serve the needy, but all of these are now required by the state to leave the country, leaving the elderly and severely disabled without a nursing solution."

Population Authority: "The application was rejected outright in accordance with the law"

The Population Authority stated in response that "as stated, the application was rejected outright in accordance with the threshold conditions set forth in the law."

It was further stated that "regarding each request that is rejected (and also in this case) we indicate in the rejection letter that a period of organization and preparation is given, which currently stands at 31.3.2021".

The Population Authority also noted that "with regard to the actions taken to relieve patients, there are a number of actions that have been performed and published, mainly in recent months but not only."
