Islamist separatism: what is contained in the counter-bill presented by the right

2021-02-02T10:51:25.513Z

The Republicans have identified many loopholes in the government text, which they will not vote "as is".

The day after the examination of the bill against “separatism” began, the LR group of the Assembly presented its counter-project.

In favor of a "

global and pragmatic approach

" to questions relating to Islamism, the right notably reproaches the government for not aiming at exhaustiveness.

The Republicans have therefore decided to formulate 40 proposals, which the boss of deputies, Damien Abad, describes as "

alternatives and complementary to the current bill

".

An initiative defended by his colleague Eric Ciotti, who called for

“concrete and strong acts”

and

“substantive work”

rather

than “slogans”

.

The elected representative of the Alpes-Maritimes then worried about

"'at the same time identity which leads nowhere"

.

"The right cannot merge into macronism"

, finally claimed Damien Abad, refusing to vote

"a text as it stands"

which, according to him,

"unbalances the law of 1905".

And ironically assert that all his colleagues are aligned and unanimous:

"There are not 50 shades of LR".

Amend the Constitution, Articles 1 and 4

After a series of interviews with experts, academics, and politicians, right-wing elected officials came to the conclusion that the fight against political Islam could only be done through constitutional reform.

"

By not proposing any constitutional measure, the government is weakening its text and showing that it lacks a real political will to fight radical Islamism

", explain the LR deputies, calling for "

rearming the rule of law

".

By taking up a proposal already formulated by senators LR Philippe Bas and Bruno Retailleau, as well as the centrist senator Hervé Marseille, the LR deputies demand

"to include in Article 1 of our Constitution the principle according to which 'no individual or group shall can take advantage of his origin or his religion to exempt himself from the common rule '

”.

They also ask, as the senatorial majority had suggested, to modify article 4 of the Constitution to indicate that political parties and groups "

must respect the principles of national sovereignty, democracy and secularism

".

And they demand "

to prohibit any person registered in the file of perpetrators of terrorist offenses to stand for election

".

Universities, hospitals, prisons, sports associations ...

If Gérald Darmanin insisted in the National Assembly on the "

remedies

" he recommends to treat a country "

sick

" of Islamist separatism, the elected LR reproach the government for not having taken enough head on the issue universities, hospitals, prisons, or sports associations identified as hotbeds of radicalization.

"We are very far from

the Mureaux speech

"

, argues Damien Abad, referring to the speech of Emmanuel Macron, last October.

To better fight radical and political Islam, the right suggests to

"give back to the prefects the competence to issue an approval to a sports association"

,

"to remove radicalized people listed in the File of Reports for the Prevention of Radicalization in terrorist character (FSPRT) of sports educator positions, on the model of what is done for sex offenders ”

or

“ to extend the control of foreign donations and funding to sports associations ”.

As for the school, LR elected officials propose to better train and support those who work there.

After the assassination of Samuel Paty, parliamentarians consider it important to

"create an offense of obstructing the teaching profession within the framework of national education programs in order to protect educational personnel",

and defend the appointment of a

“Radicalization referent”

in each higher education establishment.

LR takes up the issue of the veil for minors

On the question of the wearing of the veil by the little girls - whose amendment defended by the LREM deputies Aurore Bergé and Jean-Baptiste Moreau had been deemed "inadmissible" by the special committee of the Assembly -, the LR parliamentarians take up this subject again. on their own.

They propose “

To prohibit the wearing of the veil for minors in public spaces

” and consider it necessary to prohibit “

ostentatious religious symbols for those accompanying school trips

”.

A provision already voted by the senatorial majority in October 2019 and that the Minister of National Education, Jean-Michel Blanquer, had at the time deemed "

counterproductive

".

Immigration, the blind spot of the government project

But for LR deputies,

the

main

“blind spot”

of the government project concerns the issue of immigration.

"

How to claim to fight against separatism by not dealing with the subject of immigration and its consequences, both on the permeability of our borders to jihadists and on the impossible republican integration of newcomers in a massive and uncontrolled migratory context?

", Question the LR deputies who demand that an

end be

" put

to all illegal immigration

"and that be expelled"

effectively the individuals who are in an illegal situation on the territory

".

LR deputies also ask for the reestablishment of random checks at national borders and the supervision of land rights, a debate already put on the table by the right at the time of the 2016 primary. “

Obtaining French nationality at majority must not no longer be automatic for a minor born in France to foreign parents with

a

residence permit, but subject to a prior declaration

(called "

manifestation of will

")

made between 16 and 21 years

", suggest LR elected officials.

They also propose to extend the compulsory period spent on French soil before claiming nationality: “

A minor born in France of foreign parents will not be able to obtain French nationality at his majority unless he has previously passed less than 10 years in France (compared to 5 years today)

”, they advise.

Have Parliament vote on an "immigration ceiling"

As the right has been defending for a long time, the LR elected officials consider it necessary to "

give the French a voice on legal immigration

" and that there is in the Constitution "

an annual immigration ceiling voted by Parliament in order to control all of immigration (family, student, humanitarian, economic).

Finally, LR takes up an idea submitted by Christian Jacob to Emmanuel Macron - who had not followed up - by suggesting to "

entrust a new Stasi commission with the drafting of a Code of secularism

".

Another measure, for LR elected officials: to create, for foreigners wishing to settle in France, "

a compulsory assessment (...), relating to their knowledge and adherence to the values and principles of the Republic, such as equality between men and women, a proven command of the French language (ex: TOEFL) and secularism.

In the event of failure, this will prevent the issuance of a residence permit.

"

Finally, LR parliamentarians consider it essential "

to support the Islam of France in its structuring

" which, according to them, does not go through the French Council of Muslim Worship "

in its current form

".

But by the multiplication of the Departmental Councils of the Muslim Worship (CFCM) "in

order to start from the base and the local

".
