The Rosh HaAyin municipality refuses to provide explanations for the closure of the case of the Deputy State Attorney, Adv. Liat Ben-Ari, for construction offenses on her and her partner's property in the city. Rosh HaAyin City Council member Hanoch Oz, who filed the complaint against Ben-Ari, responded to the municipality with a request to receive the investigation materials - but was refused.

The reason: It has nothing to do with the case - contrary to the municipality's position in the past: "Since you are not the complainant in the case and you do not have the right to appeal anyway," she wrote in response to Oz. ".

This is, as stated, a contradiction to the municipality's previous position, only about six months ago: on August 9, 2020, the Deputy Attorney General sent a letter to Adv. Hadar to Oz, regarding the clarification of his complaint about the construction offenses of Ben-Ari and her partner Aviv Shuki.

The letter stated: "There is nothing in the demand of Man Dhao (complainant) in any case to guide the municipal prosecution when making the decision ...".

That is, the municipality recognized that Oz is in the status of a "complainant" in the case.

A letter from August further stated that upon completion of the investigation, "notice of the decision to be made will be given to you as is customary and customary."

As stated, the investigation has ended, but contrary to her promise from last summer, the municipality did not inform Oz about the end of the investigation "as usual and acceptable."

Ben-Ari admitted, as stated, to the offense of splitting a residential property belonging to her and her spouse.

About three months ago, on November 5, Ben-Ari was interrogated for about two hours in the municipal prosecution offices on suspicion of a series of offenses she committed on property belonging to her and her partner in the city.

As revealed in "Israel Today" last December, the prosecution in Rosh HaAyin has filed indictments in the past and imposed heavy fines on a couple of brothers living in the city, for construction offenses that are at a severity of at most similar to Ben-Ari's.

"What is to be hidden?"

We asked Rosh HaAyin Municipality a series of questions in order to find out how Oz became a "complainant" to a "non-complainant" in about six months, when and why the municipality detached Oz's "affinity" from the case and who the complainant in the case actually is.

In Rosh HaAyin, they chose not to respond to any of the questions and were content with a laconic response: "The council member's application is currently under investigation."

Council member Hanoch Oz said: "It is not clear the conduct and behavior of the independent plaintiff. It is not clear what should be hidden and why she fears that I will appeal her decision? Will her decision not stand the test of appeal? "I am not prepared to accept this position. I intend to contact the Attorney General, the Honorable Justice David Rosen, about her conduct, and if necessary, to go to court."
