The Jerusalem District Court this evening (Wednesday) annulled Shufersal's win in the Ministry of the Interior's tender for the distribution of food stamps.

The hearing will be returned to the Tenders Committee, following a petition by the Pethon Lev Association alleging defects in the procedure.

The judge further ruled that the decision to reduce points from the association's proposal is also null and void and should be reconsidered.

This is after the weekend, the court froze the distribution of food stamps that was supposed to start today.



Petachon Lev argued in its petition that Shufersal does not meet the terms of the tender, including a threshold condition according to which the bidder must present points of sale in at least 100 local authorities, as well as present a point of sale in each locality with a population exceeding 20,000.

And yet she won.

In his decision, Judge Abarbanel accepted the claim that Shufersal did not meet the terms of the tender.



According to the plan, which will be budgeted at NIS 700 million, those entitled will receive food stamps in order to purchase essential products.

Local authorities will assist in determining the list of those eligible, including recipients of a property tax rebate of more than 70% according to an income test and senior citizens receiving an income support benefit.

Shufersal attached to its proposal a table that includes 1,627 businesses, 370 branches of which it owns and the rest private businesses, according to a list provided to it by the credit company ICC, with which it has clearing agreements.

In the decision, the judge wrote that "it is not enough that the said businesses are obligated to honor ICC's debit cards, since in order to meet the terms of the tender, the businesses are required to operate under the tender under Shufersal's management, and cooperate with it in a series of actions."



Thus, among other things, the business is required to report monthly on the products purchased through the purchase labels.

"Prior to submitting its bid, Shufersal did not investigate whether the said businesses were able to provide the said monthly report; it did not examine whether the preparation of the report involved significant costs for them; nor did it determine whether they agreed to disclose the said information," the judge explained. "As long as there are more than a thousand points of sale that are beyond its control, Shufersal cannot meet the tender requirement, according to which Shufersal must transfer to the office every month during the tender period."
