Yuan Haiwen, the initiator of Hong Kong's beauty surveillance and a member of the Sham Shui Po district, held a press conference last year and pointed out that there are beauty salons operating as usual under the guise of "medicine", in violation of the government's suspension order.
One of the accused companies filed a lawsuit against Yuan for defamation in the High Court yesterday (2nd).
The company emphasized that it is a clinic. Its clinic was inspected by the police and the Department of Health, and no violations were found.
The company claimed compensation from Yuan and asked the other party to publish a statement of apology.
The plaintiff is Celebrity Medical Aesthetics Co., Ltd. and the defendant is Yuan Haiwen.
The plaintiff filed a complaint alleging that it operated two private clinics in Causeway Bay and Tsim Sha Tsui, and their business registration services were clinics. Among them, Causeway Bay was granted a day medical center license by the Department of Health.
The plaintiff alleges that Yuan, as the initiator of the Hong Kong beauty surveillance, has accused the plaintiff since 2018, including the doctor who accused the plaintiff of violating professional codes.
On December 18, 2020, Yuan held a press conference and accused the plaintiff of ignoring the government ban and continuing to operate.
However, the plaintiff emphasized in the complaint that apart from the business registration business nature of the clinic, the police and the Department of Health have repeatedly inspected the plaintiff’s Causeway Bay and Tsim Sha Tsui stores, and they have not found any violation of the suspension order and have never been approved for the beauty salon epidemic prevention fund.
The complaint alleged that the defendant's remarks were defamation of the plaintiff and criticized competitors for a familiar medical beauty company.
In addition to claiming compensation from the defendant, the plaintiff asked the court to issue an injunction to prohibit the defendant from making any further statements that slandered the plaintiff.
The plaintiff also requested that the defendant remove the defamatory statements involved and publish an apology.
