Eitting / Moosburg -After two days of negotiations, the verdict for unauthorized trading in five cases as well as the sale, acquisition and possession of narcotics in no small amount was confirmed on Tuesday.

The decisive factor for the sentence was the large quantities of cocaine that the 32-year-old had sold to his manager.

Prosecutor Isabella Bock had even demanded a prison sentence of four years and ten months.

Therefore Schladt had applied for a suspended sentence of two years.

As reported, the Moosburger had made an extensive confession at the beginning of the process.

According to this, he had sold 30 grams of cocaine several times in the spring of 2020 to his supervisor at the company he still works for today.

The boss knew that he was using drugs himself.

At some point he started to urge him to get him cocaine.

He wanted to look good with his superior, said the defendant in court about his motives.

With the sale he was also able to finance his own consumption.

The defendant had acquired the cocaine, ironically, from a colleague.

The handover took place in the company's changing room.

Schladt spoke of a "pass-through activity": his client only held the cocaine in his hands for a short time.

The drug never left the company premises.

Presiding judge Inken Bouabe rated this in favor of the 32-year-old: "The danger to others was limited." In addition, the defendant never actively sought further buyers and provided clarification assistance.

A criminal investigation officer confirmed that many of the man's statements led to further investigations.

Prosecutor Bock also credited the defendant with having unpacked.

Defender Schladt, however, missed the mitigation of the penalty that Bocks mentioned.

He referred to cases such as the highly professional smuggling of cocaine in banana boxes from South America, where less cooperative defendants had escaped with sentences of between two and three years.

Hubert Näger attested the Moosburger to be addicted to marijuana and amphetamines, but did not see his culpability limited despite the drug problem.

The Moosburger has been doing outpatient therapy since June.
