The juvenile was sentenced to three years of probation after he pleaded guilty for picking up petrol bombs in the police dormitory of the married policeman in Chai Wan during the police besieging PolyU. The Court of Appeal found that the sentence was insufficient and revoked the sentence.

When the defense interceded today (4th), it expressed its hope that a rehabilitation center with a shorter maximum detention period would be sentenced. However, a judge questioned whether it was appropriate and pointed out that if the detention period is longer, the defendant may be able to realize the mistake he has made. The court eventually commuted him to the training center.

The 16-year-old defendant, 15 years and 5 months old at the time of the incident, admitted earlier that he had set fire outside the Chai Wan married police dormitory on November 18, 2019 and was sentenced to three years of probation.

The Court of Appeal found that the sentence of the original trial was obviously insufficient, and revoked the sentence, and then asked for multiple reports for the defendant to sentence again.

The defense seeks a sentence for a rehabilitation center with a shorter detention period

The defense stated that the defendant gave up the statement that he was coerced into committing a crime. Although the report showed that both rehabilitation centers and training centers are suitable for sentence, it is hoped that the court may consider that his emotional management and ability to withstand stress have improved, and the maximum detention period may be shorter. Even if the rehabilitation center is sentenced, the court can still send a deterrent message.

The defense accepts that if the defendant is an adult, he is bound to be sentenced to several years in jail. The Court of Appeal, Peng Weichang, questioned that if the detention period is longer, the defendant may be able to realize his own mistakes and question whether the rehabilitation center is appropriate.

Officials allege that the defendant owes empathy to the residents

The representative of the Department of Justice also pointed out that the report showed that the defendant only claimed to have committed the crime recklessly and only because he worried his parents and felt guilty. He remained silent on the point that his behavior might endanger the safety of dorm residents.

The judge of the Court of Appeal Pan Minqi took the call and said that the defendant had no empathy for the residents.
