Feng Yongye, the then Deputy Secretary-General of the Bureau of Economic Development and Labor, and the husband of the high-ranking female official Feng Chengshu, was accused of collecting 510,000 yuan from the top airline executives, namely the gambling king Stanley Ho, Auntie Chen Yuen Yu, when processing the air rights approval, and did not make a declaration. .

Feng was convicted of misconduct by a public official earlier and was sentenced to nine months in prison.

The personal relationship between Feng and Chen was revealed at the original trial, but Feng insisted that he did not know Chen's identity at the time and appealed the conviction earlier. The Court of Appeal today (9th) ruled that the original trial was handled properly and rejected Feng's appeal.

The appellant Feng Yongye was originally charged with the crime of accepting benefits by a public official and the crime of misconduct by the public official.

He was found not guilty of accepting benefits, but he was convicted of misconduct, and he was sentenced to 9 months in jail. He has already served his sentence.

Senior Counsel Xie Huayuan, who represented Feng Yongye, stated earlier that the Court of Final Appeal had established a new legal principle in the former Chief Executive Donald Tsang. If a public official was charged with accepting benefits and misconduct at the same time, the prosecution had to prove that the defendant was involved in corruption. Regarding the crime of misconduct, point out the basis for the conviction of the crime not involving bribery.

The prosecution failed to do so in the original trial.

As for the original judge's ruling, it is impossible for Feng to not know the identity of Chen Wanyu in the Hong Kong Union Company involved in the case.

Xie Huayuan claimed that the original judge’s ruling was wrong. He pointed out that when Stanley Ho’s nephew, Xie Tianci, introduced Chen Wanyu to Feng’s acquaintance at the luncheon, he only revealed that Chen was an accountant and did not even mention the company she belongs to.

The Senior Counsel for the Department of Justice, Huang Peiqi, responded that the former Chief Executive Donald Tsang did not have a new legal principle in the Court of Final Appeal. He also pointed out that even if, as Feng Yongye pointed out, Chen Yuenyu’s identity was only known in May 2005, he still continued to handle it. Hong Kong Federation of Hong Kong Applications.
