If the text of the law limits the scope of ecocide by conditioning it on intentionality, the concept of “serious damage” opens up to many interpretations whose limits are difficult to predict.
The creation of this offense also demonstrates a manifest symbolic will.
The very term "ecocide" equates environmental damage to blood crimes.
Such as infanticides or parricides.
This has a weight and an importance at least comparable to the battle in favor of an inscription in the Constitution that "the State guarantees the preservation of the environment".
