The Corona measures are causing political controversy - and sometimes violent allegations from fundamental critics.

A clear positioning now comes from the constitutional court.

Karlsruhe / Düsseldorf - The President of the Federal Constitutional Court, Stephan Harbarth, has sharply criticized dictatorship allegations by opponents of the Corona policy.

"Anyone who calls the present a 'dictatorship' relativizes Nazi rule and defames the best republic in our history," Harbarth told the

Rheinische Post

.

Sometimes he wonders whether those who shouted “dictatorship” would also do so if Germany were a dictatorship.

Corona in Germany: "Dictatorship" critics run into trouble with constitutional judges

The Basic Law grants a right to resistance when attempts are made to eliminate the free-democratic basic order and other remedies are not possible, said Harbarth.

"That this is supposed to be the case today cannot seriously be argued." Attempts are being made to counteract a very large threat situation by means of the rule of law.

If the executive or legislative branch, i.e. the executive and legislative power *, exceeded limits in the process, they would be corrected by the judiciary, i.e. the judiciary.

The Federal Constitutional Court has already recorded more than 880 corona-related proceedings.

Harbarth also explains that he expects further procedures, including the vaccination sequence.

Harbarth also emphasized the role of the Bundestag in the pandemic *.

“The more important the legal interests concerned are, the more the legislature is called upon to make decisions,” he said.

"The main decisions have to be made by Parliament."

Crises are initially the hour of the executive, Harbarth said.

At an early stage of the pandemic, when it is necessary to find out which measures are actually effective, the executive's room for maneuver should be greater than in a later phase.

"The more you know, the more the legislature has to state the options for government action," said the President of the Federal Constitutional Court.

"From a certain point in time, the legislature has to give the executive more precise instructions," Harbarth emphasized.

On Wednesday, another corona summit by the federal and state governments will decide on the next corona measures.

For months, MPs, especially from the opposition factions, have been criticizing the minor influence of parliaments on decisions about measures in the Corona crisis.

A new law * brought at least some clarification in the autumn.
