The Supreme Court today (Thursday) accepted the appeal filed by the prosecution, aggravating the sentence of a man convicted of raping her 12-year-old daughter, from 11 to 14 years in prison.

In the verdict, the court wrote that "the minor, a 12-year-old girl, was raped by her mother's partner, 40 years her senior. The rape was carried out against a background of severe violence and an atmosphere of terror and severe violence perpetrated by the defendant in the family home against the two minors. The severe, long-term and irreversible damage that encompasses the entire sphere of life of the minor, necessitates that this be reflected in both the determination of the compound and the sentencing within it. "

Defendant admitted to raping the minor in April 2018, while the two were alone in the apartment.

As a result of the rape, the girl became pregnant and later even had to undergo abortion surgery.

After recovering from the surgery, the minor chose not to return home for fear of the man, so she stayed for a long time in an emergency center.

The man attacked not only the girl but also her sister.

He even hit them both with a belt and also inflicted bruises on them.

Based on his confession, the man was convicted in a plea bargain for one act of aggravated rape (in a minor under 16 and while causing pregnancy) and for aggravated assault and assault of a minor.

The district court sentenced him to 11 years in prison, probation and fines of NIS 130,000.

The criminal department of the State Attorney's Office appealed the sentence, arguing that it did not include a message of deterrence against those who exploit the weakness of minors - an appeal that was eventually accepted.

"The serious injury, the long-term and irreversible damage that encompasses the entire sphere of life of the minor, necessitates that this be reflected in both the determination of the compound and the sentencing within its scope," the updated ruling said.

"Similarly, the minor's pregnancy as a result of the act of rape, for the damages that accompanied it, is an aggravating circumstance that intensified the injury and its consequences. This circumstance must be reflected in the punitive outcome, beyond what was given by the trial court."
