A Geretsrieder stood before the youth lay judge for theft and property damage.

His sentence: eight months' youth sentence, suspended on probation.

Geretsried / Wolfratshausen - He is happy to admit that he stole the bike.

But the guy who pushes the same mountain bike off the same property that same night on the surveillance camera film, he doesn't want to have been.

Because then Geretsrieder (20) would also have to admit that the other offenses that the public prosecutor ascribes to him also apply.

Together with three other young boys, the defendant is said to have broken into a house in Geretsried-Gartenberg on April 21 last year in order to beat up young people living there.

When this project failed because the room doors were locked, the 20-year-old is said to have stolen a € 500 mountain bike from the garden shed.

Therefore, the student recently had to answer before the youth lay judge.

Owner contacts

Enlightenment was difficult there.

"This is bullshit, I would like to see evidence," poisoned the defendant.

After all, nobody can be seen on the video from the surveillance camera.

That day he met six or seven friends and three crates of beer on the Isar.

In the evening he missed his bus, so he walked.

"So I passed the alley," protested the defendant.

He added: "I was pretty tight." The next day he received a cell phone message: "You have something that belongs to me." The mountain bike owner (20) had contacted him.

Her friend recognized the alleged thief by his brightly shining sneakers.

When the bike was returned, the accused should also have confessed to having been in the house - "to intimidate someone, to set an example".

He didn’t want to hear anything about that at the trial.

“The story they are telling us here cannot have happened like that,” judge Friederike Kirschstein-Freund held against the defendant.

At his appointment with the juvenile court assistant, he admitted the theft.

"After seeing the files, they came up with a different story to cover up their buddies."

Defense attorney Carlota Hagemeyer considered a fine to be appropriate because more than the admitted theft had not been proven to her client.

Edition: 1400 euros go to the sponsoring association for youth work

The jury came to a completely different conclusion.

The verdict was guilty of attempted bodily harm, damage to property and theft.

The punishment: eight months youth sentence, suspended on probation.

The course of the crime showed "a very significant criminal energy", explained judge Kirschstein-Freund in the grounds of the judgment.

As a condition of probation, the convicted person has to pay 1,400 euros to the youth work organization.

He may not drink alcohol in public or be drunk outside while on probation.

In addition, the court ordered three consultations on addiction and violence prevention.

"So that you learn that you don't go into someone else's house with three people to beat people up," said the judge.
