- Two words too many in a classified ad brought a Geretsrieder (27) fraud case.

“With master approval”, this is how the vehicle mechanic offered a software optimization tool for motor vehicles in an online classifieds market at the end of September 2019.

But this was not the case.

Without this approval - the costs for this would have been around 500 euros - the buyer has to pay a usage fee, extra for each process.

In the meantime, he had offered to buy back the device or to obtain the master approval afterwards.

However, this failed because of the defendant's financial problems.

"That went stupid," said the accused.

“It's even stupid,” affirmed the judge, because the previously convicted 27-year-old had only been sentenced to a year and six months imprisonment by the Munich District Court three months earlier.

The sentence had been suspended for three years.

Therefore, the prosecution now requested that the man be sentenced to a further one year imprisonment, but no longer suspended.

Especially since "property crimes run like a red thread through the impressive vita of the accused," as the public prosecutor emphasized.

“He tried to make up for that,” noted attorney Stevan Krnjaic.

“If he had planned a fraud, why should he have tried to fix it?

That would make relatively little sense. ”In addition, his client is now consolidated.

“He wants to lead a normal life and has not been guilty of anything other than this.

He can't do more than that. "

Judge Helmut Berger complied with the defense's request for a “mild verdict”: He sentenced the 27-year-old to one year in prison, but suspended the sentence for four years - “with both eyes closed”.

As a condition, the convict must pay 400 euros to the injured party.
