Young people from Kochel were his target group: Between 2015 and 2019, a 28-year-old provided his customers with drugs of all kinds. He has now been convicted for this.

Kochel am See

- Something like this can probably be called a "lively trade in narcotics": In the period between mid-2015 and the end of February 2019, a Kochler apparently supplied mainly young customers with drugs of all kinds - mainly marijuana, but also LSD , MDMA and cocaine.

Now the 28-year-old had to answer to the lay judge at the Wolfratshausen district court for the sale of narcotics to minors, trading and aiding in the same as well as illegal possession of narcotic drugs.

His younger brother (26) sat next to him in the dock.

In the meantime, he had contributed psilocybin-containing mushrooms from his own cultivation to the older man's business.

The defendants were sentenced to prison terms of two years and one year and three months, respectively.

Both sentences were suspended.

Siblings make extensive confessions

The prerequisites for this were the extensive confessions of the siblings.

The court had already paved the way for this in the so-called "interim proceedings".

With a corresponding admission, the main accused was given the prospect of a "total probable sentence".

The 28-year-old gladly accepted the offer.

Although he disagreed with the prosecutor in some cases with regard to the amounts stated in the indictment, on the whole "that's true," said defense attorney Winfried Folda for his client.

The same was true for the younger brother.

Its mushroom sales totaled only around 50 grams, as its defender Peter Huber explained.

This made the matter a short process, without the 15 counts being discussed in detail.

Kripo accidentally finds out about the accused

On the trail of the older main defendant, the Kripo had come by chance: A woman had reported her partner to the police in Penzberg for assault.

His drug deals were also discussed and the name of the Kochler now sitting in the dock was mentioned.

This was at the time fleeting, but through telephone monitoring one could quickly find his whereabouts, reported the drug clerk at the criminal investigation department in Weilheim.

“There was a lot of access in the house, lots of people signed up with the usual slogans.

There were a lot of young people from Kochel there. ”However, it only became interesting when another dealer joined in.

"It was active all over the Oberland," said the witness.

And after he was arrested at a bogus deal, he unpacked extensively against the 28-year-old.

The verdict against the 28-year-old, who was sentenced to two years in prison, was guilty of delivering to minors in 11 cases, trading in 13 cases as well as aiding and abetting the trading and possession of narcotics.

The sentence was suspended for four years.

In addition, the court ordered the collection of compensation in the amount of 1995 euros - the profit from the proven transactions.

The younger brother was sentenced to 15 months for cultivating narcotics in unity with trading.

His probationary period ends after three years.

The court calculated the profit to be collected at 215 euros.

Both of them also have to have three conversations with the Caritas addiction counseling service to determine whether there is a need for therapy.

The very mild two years for the 28-year-old were also due to the fact that the public prosecutor specifically classified the submission to minors as a less serious case, explained Judge Helmut Berger in the grounds of the judgment.

"And," he emphasized once again, "their flight forward ultimately led to a mutually acceptable result."
