The Nursing Department of the University of Hong Kong was accused of blocking the road with anti-collision poles on the Tai Po Highway during the "Three Strikes" operation on November 11 of the previous year. He was convicted of causing obstruction in public places and sentenced to two months in prison.

He was dissatisfied with the conviction and sentence and filed an appeal. The High Court opened a court session today (23rd). The appellant questioned the police officer who admitted the wrong person. However, after hearing the submission, the judge Peng Baoqin immediately rejected the appeal and the appellant must serve his sentence immediately.

The appellant Zheng Kaizhen (20 years old) was accused of occupying the road with three crash barriers at the roundabout of the Yuan Chau Tsai section of the Tai Po Highway that day.

The defendant was charged with assaulting the police, but the trial magistrate refused to accept the police's testimony, so he was convicted.

The appellant’s lawyer stated that no one was able to pinch obstacles to the roundabout at all in the footage involved, questioned the police officer’s identification of the wrong person, and believed that the trial magistrate’s inference was inappropriate.

The prosecution retorted that all the factors in the case had been considered in the original trial and there was no error.

The case alleged that when a police officer drove a private car past the scene at 6 o'clock that morning, he found a man and a woman throwing a railing towards the road, but he returned to the scene to uniform and arrest the two after he picked up his colleagues nearby.
