While still a prisoner in the house, Amado Boudou can already request temporary exits

Judge Daniel Obligado reduced the terms of his sentence by ten months and

since no one appealed that decision

, it remained firm from this week.

Now, under these conditions, the former vice president could begin requesting temporary exits.

Meanwhile, the Chamber of Cassation stretches a definition about his return to prison.

For now, the former vice, continues with house arrest in a house with a park, pool, elevator and barbecue.

Amado Boudou was sentenced in August 2018 to 5 years and 10 months, in the Ciccone case.

The Federal Oral Court 4 (TOF 4) found him responsible for the crimes of bribery and incompatible negotiations for keeping the ticket machine.

That sentence was unanimously confirmed by the Supreme Court of Justice in December 2020.

After that decision, an extensive judicial journey began to determine where he should serve that sentence.

Since April 2020, Boudou has been under house arrest after the then Criminal Execution Judge, Daniel Obligado, considered that in the midst of the Covid19 pandemic, it was better for his young children to remain at home.

In addition, the judge argued that the conviction of the Ciccone case, handed down in August 2018, was not yet final, a situation that was reversed last December.

When the decision of the Supreme Court was known, the execution prosecutor Guillermina García Padín and the prosecutor who intervened in the trial, Marcelo Colombo, ruled that Boudou should return to jail and there serve his sentence.

However, the Obligado judge only set the date on which the sentence would be served: June 1, 2024. It was after two requests from prosecutors, that finally on December 31, the magistrate revoked the house arrest, ordering that the former vice president of Cristina Kirchner, I returned to the penitentiary.

In the middle there was another decision by the Obligado judge: he reduced Boudou's sentence by ten months.

The account determines that with this modification, he will be able to access the temporary exits and is approaching parole when he reaches two-thirds of compliance with his accusation.

It only remained to wait within the legal deadlines for someone to appeal the ruling.

that the prosecutor's office in charge of Colombo, who had endorsed the reduction for only six months, did not object, nor did the lawyers Alejandro Rúa and Graciana Peñafort reject the terms of that resolution.

Thus, a few days ago, the reduction of ten months was firm.

What allowed the former vice president to reduce his sentence for ten months was the request of his lawyers, Rúa and Peñafort (who also serves as Cristina Kirchner's advisor in Congress), appealing to the educational stimulus (Article 140 of Law 24,660).

That was the argument invoked by the defense and that enables the reduction of ties to access a temporary exit, such as parole.

It was in this framework that - despite the fact that the prosecutor Marcelo Colombo had endorsed a reduction of six months - the magistrate considered the course of Programmer of a personal computer database system, with a load of one hundred and eighty (180) hours duration ;

All courses were in charge of the Professional Training Center No. 401.

In the ruling that was now final and which was denounced by the opposition as a "disguised pardon", the Obligado judge highlighted "the importance of education in the prison system, and that is why I consider it appropriate to assimilate the aforementioned Philosophy Workshop to a professional training course, pondering the importance for the personal development of the incuso ".

Thus, when computing the time load of all the courses that Boudou took

during his stay in the Ezeiza Prison, he

considered that his sentence should be reduced by about ten months.

The former vice of Cristina Kirchner who is under house arrest, continues to study.

According to what was reported in court, he took the course for the Diploma at the Latin American Faculty of Social Sciences (FLACSO).

Likewise, he enrolled in the Curricular Complementation Cycle of the Bachelor in History of the National University of Avellaneda (UNA), of the Doctorate in Social Sciences of the University of Buenos Aires (UBA), of which he passed some subjects.

With the possibility of accessing transitory exits, in the coming weeks Room IV of the Cassation Chamber will have to decide whether Boudou returns to prison to serve his sentence or will remain at home.

The defense appealed that, after two requests from the prosecutor Colombo and his partner Guillermina García Padín, the moderation of his arrest had been revoked, which would force him to return to prison.

Upon returning to the Ezeiza Prison, and due to the reduction of his sentence, he will be able, however, to access the transitory exits and approach with the same to the fulfillment of two thirds of his total sentence, which will allow him to request conditional release .

Boudou entered prison three times.
