Now one had to discover with astonishment that the district building authority is threatening to replace the communal agreement.

"Helpers in the real estate industry"

According to the authority, the building project fits into the surroundings according to the extent of the structural use.

In addition, the district office recognizes a reference case in a “three and four-in-hand man”, according to the Tölz building authority manager Christian Fürstberger.

The municipal building authority still regards the level of structural use as exceeded and does not recognize any reference case.

A semi-detached house alone is justified, nothing more.

In order to be legally on safe ground, according to Mayor Ingo Mehner, a development plan is now being drawn up.

The city council agreed unanimously and imposed a ban on changes to freeze the status quo.

If, by the way, the builder responds to the city's ideas (semi-detached house), he can build despite the ban on changes, Fürstberger corrected an often-cherished misunderstanding.

Legal battle is likely

Not all councilors were sure this was the right way to go.

Especially since a legal dispute is likely, as Filiz Cetin (SPD) said.

Anton Mayer (CSU) recalled the city's legal defeat in the Bruckfeld building issue and asked whether Fürstberger would also pay his obolus if the city lost.

"But we will use all of the know-how we have so that we can survive in court."

René Mühlberger (CSU) made it clear what it was about.

"If that goes through up there, we have a reference case for the further development in the quarter." He is therefore grateful that the administration is tackling the case.

“Persistence in the wrong thing must not be rewarded.” Mühlberger was disappointed by the district administration.

Franz Mayer (Greens) formulated the tone much more sharply.

He described the district building authority as “helper in the real estate industry”, which “simply overrides the city's will to plan”.

"This authority is not there for the people who live here."

Mayer also gave the example of Schützenstrasse and accused the district building authority of driving up the already high property prices even further.

The former city architect Hannes Strunz had already pointed out this problem in the Ketteler-Ring case, said Fürstberger Franz Mayer “completely right”.
