It blows like a wind of freedom found on the northern heights of the Hérault department.
The Montpellier tribunal de grande instance has in fact just asked the renewable energy company of Languedoc (ERL), owned by the energy company Valeco, to destroy 7 wind turbines 93 meters high located in the town of Lunas, between Pays Lodévois and Larzac, in the north of the department.
On the legal level, the decision of the tribunal de grande instance is part of the logic of administrative justice.
Three times in this case, the Council of State has in fact invalidated the construction permit for these wind turbines, in particular because of a lack of impact studies on poultry fauna.
Nevertheless, the court order to dismantle wind turbines would be unprecedented in French law.
