Pensioner from Lenggries strikes with a shopping basket - judgment: Serious bodily harm

There a pensioner (77) had to answer for dangerous bodily harm.

Lenggries / Wolfratshausen - The 77-year-old is said to have injured a neighbor with a bunch of keys.

That was probably not true: During the hearing it turned out that the old lady had struck with a shopping basket.

That changed nothing in terms of the charge - and neither did the punishment.

This amounts to 100 daily rates of 25 euros each.

"I would like to say that that is not true," defended the pensioner.

When she came out of the cellar that day, it was September 4th last year around 6 p.m., the injured party stood in her way.

“She came very close.

Without mask.

She said she was going to tell me, "the defendant reported.

She then "sprayed the other one very lightly" with a disinfectant.

Whereupon the neighbor (46) gave her a watschn on the ears on the right and left.

"That was terrible pain." She could not substantiate this claim.

Verdict: Serious assault

The 46-year-old curative educator, who had filed a criminal complaint against the pensioner, described a different version.

The defendant had "sprayed vinegar essence all over the house".

And not for the first time.

"She held the bottle in front of my face and started spraying." She "turned the hand with the bottle away," and the accused slammed the basket.

The injured party suffered bruises on the palm of her right hand while trying to defend herself.

Penalty: 100 daily rates of 25 euros each

"Because of the two, more operations were necessary," a police officer reported to the judge.

Two witnesses confirmed both the long-running quarrels and the version of the injured party from the day of the crime.

Judge Helmut Berger saw the defendants' guilt as proven, but assessed the act as a less serious case.

So the pensioner got away with a fine of 100 daily rates, which added up to 2500 euros.

The legislature provides for a minimum of six months in prison for dangerous bodily harm.
