"Then she freaked out brutally and hit me immediately," said the Fischbachauer, describing the argument in the bedroom.
He resisted easily, pushed her away from him.
"I didn't touch her neck, I didn't hit or kick her either," the defendant made clear.
Couple asked prosecutors to stop prosecution
However, it was precisely this hitting, kicking and choking until he passed out that the public prosecutor accused him of.
The situation in the courtroom upset the Fischbachauer so much that he talked himself into a rage again and again.
He is the victim, not the perpetrator.
"But why are we sitting here anyway?" He asked.
"We spoke out the day after and wrote a letter together that the prosecution should be lifted."

What at first sounded like trying to avoid punishment later turned out to be something completely different.
In truth, it was an attempt to protect his fiancée from punishment.
She testified as a witness, so this time did not make use of her right to refuse to testify.
And what she said came as a surprise: “I told the police that he hit and kicked me - but that's not true.” The 25-year-old explained that her future husband did not twist a hair.
“We had an argument, I went nuts,” confessed the Fischbachauerin.
"I'm very jealous, that's why I freaked out about it."
Victims: injuries occurred when falling down stairs
The 25-year-old suffered visible injuries on the evening of the crime.
They arose when the 30-year-old wanted to leave the house after the dispute.
"I wanted to stop him, I ran after him and fell down the stairs," said the witness.
The fact that she reported her fiancé to the police was a short-circuit reaction.
"Because I was mad at him."

The otherwise so level judge Walter Leitner was also angry.

For this, the 25-year-old may have to expect criminal consequences because of false suspicions on her part.
