In the video: Lawyer Rina Politi on resolving disputes between spouses (Walla! NEWS Studio)

Some couples already know that they are approaching separation, but in such cases it can be important for the date and especially for the question - which of the spouses started the process and opened a request for conflict resolution.

To dive into the depths of the subject, Rina Politi, who specializes in family law and divorce, came to the studio.

What is the law for conflict resolution?

"This is a law for arranging litigation between spouses. In the past the court used to refer couples to the assistance unit, but today it is already mandatory for them and there they check whether the spouses are suitable for mediation and try to end the disputes outside the court. This law actually taught both parties and Their lawyers are talking. "

And what are the options available in case the conflict resolution is not successful?

"If one party wants revenge, nothing will help. He will come, mark 'V' and announce a shortened procedure. At the end of the procedure the parties receive something called 'Form 3' and it says whether the parties want to continue the procedure, up to four sessions, starting from the second session. "You can be represented by a lawyer. If that doesn't work, you have to go to court."

How necessary is it for the client to get to the process accompanied by a professional lawyer, who specializes in the field?

"The aid unit does not have the necessary tools to check the economic map or maintain the client's interest. He should make sure that there are agreements and the procedure is effective, but at a later stage one of the parties may feel he was harmed by the agreement or defrauded and reopen the procedure. "In order to reach a good agreement, it is important to reach out to a lawyer, even to consult with him behind the scenes. It is much cheaper than going to war in court."

Is the dispute resolution process more important if the couple then decides to go to the rabbinical court?

"According to the law, the party requesting the settlement of the dispute first has the option of acting in a court of law, as long as the case is closed within the number of days stipulated by law - 60 days from the opening of the case. Therefore, whoever sought the settlement" bought "the agreements to decide where to file the case. "Before referring to the negotiating table at all, we need to know what our financial situation is and only then get to the discussions, in order to know how to end the issue as quickly as possible, with minimum expenses and most importantly, for the benefit of the whole family."
