Today, the People's Assembly, in its sixteenth session of the second regular session held under the chairmanship of Hammouda Sabbagh, Speaker of the Assembly, continued the discussion of the articles of the new civil status bill.
The House approved by majority the articles 35 to 48 of the draft law, as Article 36 stipulates that the duty to notify the incident of death falls on the deceased’s ancestors, descendants or spouse, and relatives of the deceased who are legally up to the fourth degree may notify his death.
Whereas Articles 37 and 38 included the registration of death according to a certificate from the mayor attached to a medical report proving that the death is natural and in places where there are no doctors it is sufficient for the mayor to testify that the death is natural and that deaths occurring in prisons, quarries and hospitals are recorded based on certificates provided by the directors of these institutions or from The head of the competent center shall act on their behalf, and these institutions keep records of these incidents.
Article 40 states that the ruling on deaths that occur during sea travel is the same as deaths that occur in the country whose flag the ship flies. As for deaths that occur on airplanes, the pilot of the aircraft organizes a certificate that will be delivered to the nearest center, embassy or consulate of Syria at the first port the plane reaches.
While Article 42 clarifies in its first paragraph that the deaths that occur during the Hajj, the director of the Hajj accompanying the Hajj procession records them after verifying their occurrence in a special register prepared for this purpose and upon his return to the country he submits to the Ministry of Interior a death certificate for each incident that includes what information can be obtained This certificate shall be communicated to the head of the competent center to place the death indication on the record of the deceased.
And it was stated in the second paragraph of the same article that the deaths of pilgrims that were not recorded in the first paragraph within a period of thirty days from the date of the arrival of the last group of pilgrims, based on a death certificate organized by the competent authorities, and a death certificate organized for him in the Hajj Directorate signed by two witnesses who attended the death .
According to Article 44, it is not permissible to make any amendment or correction to the civil status records except on the basis of a final judgment. The civil magistrate’s court has jurisdiction to consider cases related to requests for correction or amendment. The court examining the case requests the competent directorate to nominate a representative to attend the case, and the representative must attend. In person, it is not permissible to make any correction or amendment on the date or place of the occurrence of the registered birth within the legal period or outside it except with a claim of forgery, and lawsuits to cancel or correct the restrictions may be submitted by the Public Prosecution, the head of the center, or by any person who has an interest in that.
The head of the office of the competent court must notify the peremptory judgments it issues within a month from the date of their issuance to the head of the center at the place of registration. It is prohibited to record these judgments except after they acquire the peremptory degree according to Article 47 of the draft law. The issuance of a judgment or a civil quarantine document that indicates the registration of its owner.
