The Government is preparing to launch

a new offensive on Justice.

In his speech this Monday before Congress for the opening of ordinary sessions, Alberto Fernández will claim for the sanction of two initiatives that have received half sanction from the Senate since last year and are bogged down in Deputies.

These are the Federal Justice reform law, which aims to liquefy the power of Comodoro Py, and the reform of the Public Prosecutor's Office, which aims to displace the interim prosecutor

Eduardo Casal

but

also facilitates the process of appointment of his replacement

.

Some versions also indicate that the President could also announce the sending to Congress of the project to create a Federal Court of Arbitrary Sentences, which could be below or almost on par with the Supreme Court of Justice, depending on the model he chooses. .

The formation of this court was one of the recommendations of the jurists who made up the so-called "Beraldi Commission", which last year made a series of proposals to change the Justice.

The projects of judicial reform and that of the Public Prosecutor's Office were included by the President in the agenda of the extraordinary sessions of Congress.

But both initiatives remained unaddressed

.

The problem of the ruling party is that it does not have the votes for its sanction in Deputies.

The Frente de Todos -commanded by Máximo Kirchner- has 119 deputies, but strictly speaking it has 117 votes because the president of the Chamber, Sergio Massa, does not vote, since José de Mendiguren is on leave.

Thus, the ruling party is obliged to close an agreement with some sectors of the opposition.

Together for Change has already ruled against both laws.

Kirchnerism and La Cámpora are waiting for what Alberto Fernández will say in Congress this Monday.

But they warned that it is not enough for the head of state to "

make a diagnosis or a series of exclamations. That is not the solution. He must act."

What's more: other sources of Christianity spoke of "

discomfort" and "concern

" in the ranks of the Frente de Todos because the reform project of the Public Prosecutor's Office continues without being sanctioned.

"Here the decision of the Executive Power was lacking

,

" they

denounced with their sights set on the Minister of Justice Marcela Losardo.

The official is Alberto Fernández's terminal and does not have her own autonomy.

"No one saw the minister trying to convince the deputies of the need for reform," they complained.

"Casal was the pillar of

lawfare

for more than a year and two months of Alberto Fernández's administration, he continues as interim attorney," said, indignant, a Christian legislator

.

The demand for "action" to the President is very concrete.

That he negotiate with the governors that is necessary to secure the votes that allow the sanctions of both laws.

According to Kirchnerism sources, the approval of both initiatives cannot be negotiated by Sergio Massa or Máximo Kirchner.

"For these laws, votes are not obtained by promising a gutter cordon in a municipality or the presidency of a commission.

It is a negotiation that only the President can face

," they stated.

Of both initiatives locked in Deputies, the key to Kirchnerism is the Reform of the Public Prosecutor's Office.

The project with half sanction makes the majority more flexible to appoint the attorney.

Currently, two-thirds of the Senate (48 votes) are needed to agree;

the reform proposes that he be appointed by an absolute majority, that is, 37 votes.

The Frente de Todos has 41 senators.

Another change is that it limits the mandate of the attorney -now for life- to 5 years, although it may continue for another similar period if it has a new agreement from the Senate.

It also indicates that in the event of a vacancy or extended leave of more than 30 days, the position of chief prosecutor will be held by a prosecutor or a district coordinating prosecutor chosen by the Bicameral Commission for Monitoring and Control of the Public Ministry.

This would allow the ruling party to displace Eduardo Casal after the sanction.

The judicial reform project was approved last August by the Senate.

It aims to liquefy the power of Comodoro Py - it takes the number of Federal Courts from 12 to 46 - and, after negotiations with the governors, enlarges - with more than 60 new federal courts, 9 Appeals Chambers and oral courts - the judicial structures of the provinces.
