She had been assigned by three gendarmes, responsible for the arrest of her brother, Adama, in Beaumont on July 19, 2016 for the publication, between September and November 2019, of five messages published on the Facebook page of the "Truth for Adama" committee. Who presented them as having caused his brother's death.
Assa Traoré was convicted on Friday in civil matters by the Paris Court of Appeal for infringing the presumption of innocence.
In its decision, the court underlines that the law “does not prohibit reporting on ongoing legal cases and even granting particular credit to the prosecution's thesis, but only if, of all the comments , does not emerge a clear affirmation of guilt ”.
However, she considers that Assa Traoré "violated the presumption of innocence" of the gendarmes.
The court orders the deletion of 2 of the 5 messages
She orders the deletion of two of the five messages - it has not been established that she is the author of the other three - from the Facebook page, the publication of a court press release evoking this conviction under penalty of penalty and the payment of € 4,000 in legal costs to the gendarmes.
"It is a victory because all the passages pursued are considered to violate the presumption of innocence", welcomed Me Rodolphe Bosselut, lawyer for the gendarmes.
However, the soldiers, who each demanded 15,000 euros in damages, were dismissed.
For the time being, Parisian investigating judges are still investigating the death of Adama Traoré.
At the age of 24, he died in the Persan barracks, two hours after his arrest in Beaumont, at the end of a chase.
The causes of his death are the subject of a battle of experts.
The latest, signed on January 13, reports a "heat stroke", which "probably" would not have been fatal without the arrest of the gendarmes.
Me Yassine Bouzrou, lawyer for Assa Traoré, declined to comment.
