An extensive list of judges and prosecutors were intimidated by ANSES.

In the midst of this judicial tension, the Council of the Magistracy intervened and a few days ago, sent a note to Fernanda Raverta to explain the scope of the measure and its objective.

"I have the pleasure of writing to you (...) in order to request that you send the resolution (s) that may have been issued in relation to the implementation or effects of Law 27,546 from which directed submissions could be derived. to Magistrates and Officials of the Judicial Power of the Nation, who implement their cessation or resignation within 30 days, "says the note signed by the new president of the Council of the Magistracy, Diego Molea.

Molea representative of the academics in the Council and also aligned with the ruling party had to send the letter to the Anses after several pressures from the opposition sector within the Magistracy.

The decision was made after a plenary session in which the PRO deputy and opposition councilor Pablo Tonelli questioned the advance of the Anses on the judges and prosecutors.

In a letter dated February 17, he argued that the summons to the magistrates "is unconstitutional because it may have the effect of depriving a citizen of his acquired rights" and also added that it is "a clear attempt to undermine the functional guarantees provided in the National Constitution ".

The representatives of the judges, Ricardo Recondo and Juan Manuel Culotta - who align themselves with the opposition - also requested that the Council ask the pension agency for explanations.

Recondo, in that plenary session, also argued that it was a "violation of acquired rights" and that it went against "the independence of the judiciary."

Even the former president of the Council also aligned with the ruling party, Judge Alberto Lugones, acknowledged that there were judges "very concerned" and that they should address the issue in the Council.

The Executive Power Counselor, Gerónimo Ustarroz, agreed to discuss the issue but asked "not to be guided by the media agenda." 


With that pressure as a backdrop, Molea sent the letter to Fernanda Raverta, head of the organization.

In fact, the letter is a formality and seeks that the Anses send the resolutions.

With these documents in hand, the Council will begin to discuss the pressure on the magistrates.

This Thursday they will discuss the issue at the Labor meeting.

The modifications to the retirements of magistrates and prosecutors were the product of a project that President Alberto Fernández sent to Congress, where he referred to privileged retirements.

While the ANSES maintains that the request to the judges deals with an administrative and orderly measure - since they found 200 inconclusive pension files - from the Judicial Power, the reading does not move away from the marked confrontation that they have with the Casa Rosada.

The crossfire added another chapter during the opening of the legislative sessions.

This Monday, President Alberto Fernández pointed against the Supreme Court of Justice, but also spoke of reforming the Council of the Magistracy responsible for the appointment of judges and their prosecution in case of having complaints.
