The summary judge of the administrative court of Dijon, seized by the prefect of Saône-et-Loire, suspended the mayor's order of March 1, 2021 authorizing the funfair from March 5 to 14, 2021, the court said in a press release. .

The judge underlined "

the incompetence of the mayor to decide to relax the restrictions decided by the Prime Minister under the special police powers conferred on him by the state of health emergency

" and the "

direct violation of the decree of 29 October 2020 banning fairgrounds,

”said the court.

Gilles Platret, also LR leader in the regional elections in Burgundy-Franche-Comté, came to defend his decree in Dijon, accompanied by a hundred fairgrounds and supporters, who brandished a giant banner marked "

We are traders and we want to work

”.

Speaking in front of the small crowd, the mayor, customary of controversial decrees defying prefectural bans, had assured wanting to defend fairgrounds who "

want to live without endangering anyone

".

We must offer a lull, a breath to the population.

I need to ensure the psychological health of the population of Chalon-sur-Saône and this fun fair takes part in it,

”he added.

In early February, Mr. Platret had already threatened "

not to stop there

" when the prefecture of Saône-et-Loire had signified the ban on the traditional funfair "

without any consultation

", according to the elected official.

"

I do not know when this shipwreck of the State will end but it is an intolerable situation

", he had reacted, assuring that, for him, the fun fair was "

not canceled

".

Known for his outspokenness and his mistrust of the current government, Gilles Platret had already authorized, at the end of October, the opening of non-food businesses in his city, thus defying their nationally decreed closure.

The municipal decree had been challenged by the courts.
