The chairman of the Southern District Council, Law Kin-hee, was dissatisfied that when the district council wanted to discuss the police's issue of mentally incapacitated persons in the district, the secretary of the council left the seat for non-district issues and did not deal with the agenda afterwards.
Luo earlier filed a judicial review and asked the secretary of the district council to handle the work.
The judge of the High Court today (3rd) handed down the verdict, believing that Luo's case is arguable, and granted permission for judicial review.
The applicant was Luo Jianxi, and the respondent was the secretary of the Southern District Council.
Judge Zhou Jiaming stated in his judgment that if the issue involved is the scope of the district council’s advice to the government, and the respondent did not deal with the agenda, it may violate his duties.
