The paint worker was found hiding two styluses in Mong Kok on Halloween the previous year. He was charged with possession of objects and damaged property. The worker denied the accusation. After the case was heard earlier, it was decided today (3rd) in the West Kowloon Magistracy.
Magistrate Liu Shuxian alleged that the stylus held by the defendant was wrapped in newspaper and plastic paper. There was no illegal incident near the scene of the crime. He failed to prove that the defendant possessed the stylus for illegal intent, and finally ruled that the defendant was not guilty and was released in court.
The defendant Zeng Jinwei, 21 years old, a painter, holds a registration certificate for persons with disabilities, and is an intellectually disabled person.
He was charged with one count of possessing anything with the intent to destroy or damage property, alleging that he possessed two stylus pens at the junction of Mong Kok Road and Shanghai Street on October 31, 2019. He denies the charge.
The prosecution alleged that there were demonstrations related to the 831 incident at Prince Edward Station that night. The defendant passed through the scene with a long object in his hand and wore black shirts and trousers. The attire was similar to the demonstrator. Fleeing, he was finally stopped by the police, and the stylus he was holding fell beside his feet.
The defendant did not answer what the police officer was doing or what the stylus was for.
The defense witness gave evidence that the defendant had borrowed two stylus pens from him earlier to dismantle the cabinet, and planned to return the stylus to him at a restaurant on Xincang Street on the day of the crime.
The defense stated that the sleeves and headgear found in the defendant’s backpack were used by the defendant when working in a hair salon.
Magistrate Liu Shuxian said that the stylus was wrapped in newspaper and adhesive paper. The newspaper was never opened. He believed that it was wrapped before going out. There was no illegal incident near the crime and failed to prove that the defendant possessed the stylus for illegal purposes.
The magistrate also mentioned that the defendant cannot be ruled out because of her background, she was frightened and ran when the police officer stopped drinking, so she was found not guilty.
