With 10: 3 votes, the application was again rejected by a clear majority.

Negotiations on the construction project have now dragged on for over a year.
In addition to the sheer size of the planned stable, the municipality cites other aspects that would speak against it.
Because of the proximity to the next residential development - about 350 meters - she fears that she will complain from neighbors in the future because of the expected noise emissions and unpleasant smells.
In addition, part of the site would have to be filled up three to four meters to create a level stable floor.
This is in stark contrast to the current local planning statutes.
Stall restricts the community's development opportunities
The town hall chief again cited another argument against it: “With the building, the community is severely restricted in its future development opportunities.
We have to plan towards the north, as we will come to a water protection area on the southern edge of the village of Bichler. "
Thomas Schäfer stated: “Even if it is basically a good thing that a young farmer is so committed and planning for the future, the whole thing is far too big and too close to the village for me.
That is why I will vote against it again, even though I am aware that we will then be overruled by the District Office. "
The client would be willing to compromise
Mair was ready to compromise.
In the planning presented now, the building was moved a little further away from Penzberger Strasse.
In addition, instead of one structure measuring 85 by 35 meters with a gable height of just over ten meters, two parallel structures with dimensions of 95 by 21 and 75 by 15 meters are planned.
Due to the double gable, the stable would only be 7.5 meters high.
But even that could not convince neither the building committee nor the local council.
The crux of the matter, however, is the privilege of an agricultural property.
"And as you know, it stings everything," says Pössenbacher.
Therefore, the district office of the municipality also wrote, "a building permit cannot be refused."
Since the council body was aware of this, the rejection was intended to demonstrate its attitude towards the population.
“That is hopeless,” said Werner Krönauer and so he, Franziska Waldherr and Xaver Bauer voted for approval of the building application.
"If our agreement is now replaced by the district office," said Pössenbacher in conclusion, "the municipality will only have the right to file a lawsuit."
