It was a particularly traumatic event, which almost ended in disaster.

A man determined to have collapsed under the task load, collapsed in front of his soldiers, lost his pulse and breathing and was flown to Soroka Hospital with no signs of life.

Only after two days and following intensive medical treatment - his life was saved.

Since then he has not regained consciousness, but the state has refused to take responsibility.

Six years later, the court ruled that the exceptional circumstances, stress and pressure led to the unusual event and ordered the Ministry of Defense to grant him the appropriate medical recognition and treatment.

It happened on Passover 2014. K., a veteran permanent man who served as a "deployment officer" at one of the Air Force bases in the south of the country, was under heavy pressure.

As part of his job, he was responsible for coordinating all administrative activities at the base, 24 hours a day, while handling construction, administration, cleaning, maintenance, order preparation, external factors event, holiday events management and more.

On the same day that began in the early morning, a holiday parade was to be held, which included many and varied tasks.

K., who rode a motorcycle around the base, while operating his subordinates, did his best to meet the targets and at the set time.

However, many delays, some of which were due to non-performance of junior soldiers, caused him to crash to the floor.

A doctor who arrived at the scene found him in a critical condition with no pulse and breathing, apparently after a serious heart attack.

He underwent resuscitation for about 40 minutes, a helicopter from Unit 669 was called to the scene and he was rushed to a trauma room at Soroka Hospital and underwent prolonged resuscitation.

K. turned to the Ministry of Defense and claimed that without any medical history - the special circumstances of his service are what caused the incident in which he almost lost his life, and therefore demanded recognition as an IDF invalid. After his request was not granted, he appealed to Eli Saban seven.

The court, which relied on the opinion of an expert who believed that there was a direct link between the extreme pressure the permanent man was under and the past medical incident, ruled that the responsibility for the incident and the treatment of the permanent person - rests with the state.

"Only in the miracle of this case did it not end in the loss of unnecessary human lives," concluded Adv. Saban. "The human body is not a machine and the court's decision should resonate with every IDF commander."
