TSV Schliersee and owner of the old sports home in court

Schliersee - TSV Schliersee has a beautiful new clubhouse. But there is still trouble with the old one, which is right next to it. Schliersee - TSV Schliersee has a beautiful new clubhouse.

But there is still trouble with the old one, which is right next to it.

The owner, who once rented the property to the club, is demanding around 40,000 euros from the club for the renovation of the old footballer's home, possibly also for demolition.

He also wants more than just a right of way to his island property.

Because in order to get there, he has to have properties owned by the TSV.

Yesterday the parties met at the Munich II Regional Court. Still without result, the parties are supposed to continue negotiating.

Lawyer: "The chemistry has been bad for years"

The presiding judge Andreas Zeug was of the opinion that the matter is not ripe for judgment.

He tried to persuade the brawlers to come to an amicable settlement.

“The question arises as to whether, with a little creativity, solutions can be imagined that everyone is satisfied with.” He first explored the chemistry.

But apparently it doesn't look good there.

"The chemistry has been very bad for years," said Birgit Baudisch, TSV's attorney.

The chairman tried his luck anyway - and asked the plaintiff, the owner of Unterschwaig nearby, if he could imagine a sale;

then there would be peace once and for all.

"No," replied the landowner.

The trend is to invest in land.

"Why should I go in the other direction?" But then he gave himself up to the idea, if he could buy "something adequate" again in a sale, he said.

The club wanted to buy, but the owner didn't want to

Hubert Strobl, head of the soccer division, emphasized that he would take immediate action.

“We wanted to buy before,” he said, “but the plaintiff said the same thing as now: The farmer does not sell.” Strobl made another suggestion: TSV Schliersee would rent the property again.

But then you would dismantle all pipes (water, electricity) and use the building as a simple warehouse.

The plaintiff was not averse.

Old sports home: the price called too high

So both options now seem conceivable.

The crux of the matter now is the price.

The farmer spoke of 15,000 square meters.

Given today's property prices, there would be “a sum of money”.

The chairman threw a purchase price of 100,000 euros into the room.

The property owner considered this to be conceivable in principle.

But he also had to talk to his court successor about it.

Strobl declined to accept this amount.

Even the demolition of the old clubhouse would cost 30,000 euros.

So you can only pay around 50,000 euros.

Lawyer Baudisch added that the association was building a new gym in Neuhaus and actually had no money.

The club may rent the sports home back

Then there was a discussion about renting.

"It's more charming than speaking any judgments," said the presiding judge.

The farmer's lawyer, Professor Walter Beck, reported on rental negotiations with a physiotherapist.

The home would have to be prepared for that.

But Baudisch contradicted this.

The project is outside and is not privileged.

The local council rejected it (see box).

Lawyer Baudisch, however, was open to negotiating again at legal counsel level.

However, the association could not pay the same rent as for a physiotherapist's practice.

Strobl himself has a price in mind that is below the old one.

Lawyers should seek an agreement

Now both parties want to try to come together out of court after all.

"Neither of you seem inflexible now," said the presiding judge.

Both sides smiled at this sentence.

But no one contradicted.

The chairman advised them to “let go of the subject of the dispute and look to the future”.

And wished "good luck".

You now have until April 12th.

If they have not come to an agreement by then, the court will decide how to proceed.
