Rachida Dati: "What is proposed is not a profound reform of justice"

2021-03-08T19:40:25.431Z

The former Minister of Justice tackles the bill presented by Eric Dupond-Moretti, and comments for the first time on Nicolas' conviction

The mayor (LR) of the 7th arrondissement of Paris, ex-Keeper of the Seals Rachida Dati, discusses Eric Dupond-Moretti's justice reform project.

She evokes for the first time the conviction of her mentor, Nicolas Sarkozy, and affirms that she does not imagine that he can support any candidate other than that of the right in 2022.

Do you find it normal that the police evacuate the quays of the Seine for health reasons, as they did this weekend?

RACHIDA DATI.

Since the first confinement, we know that there is a problem of flow control in the public space in Paris and in particular in certain places of walk such as the quays.

The footage from last week should have made it possible to anticipate what was to happen this weekend.

The management of platforms and public space is the responsibility of Anne Hidalgo and it is clear that she is doing nothing to limit the spread of the virus.

As it did not organize anything and that Paris does not have a municipal police force to regulate the flows, the police headquarters had to replace municipal responsibility.

Would you find it relevant to push back the curfew after 6 p.m. in Paris, as Anne Hidalgo mentioned?

A few days ago, Anne Hidalgo proposed strict confinement.

Today she is proposing to push back the curfew schedule.

These words are both incoherent and contemptuous for Parisians and Ile-de-France residents.

Are you in favor of setting up a vaccination passport?

A health pass to experiment with resumption of activities, why not?

But the passport can only be considered if the vaccine is accessible to everyone.

As a former Minister of Justice, what is your view on the reform of justice that Eric Dupond-Moretti is about to present?

What is proposed today is not a profound reform of the justice system to restore confidence between the justice system and the citizen.

It is a series of technical measures.

The urgency, because of the explosion of delinquency, is to quickly adopt a penal policy and a strategy of restoring order.

This is what is lacking today.

In-depth reform of justice requires a broad democratic debate and the presidential election is the best framework.

The principles to be reviewed must relate in particular to the responsibility of magistrates, the rights of the defense, the establishment of a real penal code for minors and a real penitentiary policy.

In particular, it proposes the abolition of automatic penalty reductions.

A good idea ?

The automatic reduction of sentences does not exist in the Code of Criminal Procedure.

Any reduction in sentence is conditional either on good behavior or on reintegration guarantees.

So, this is a bogus topic.

The subject is to give each prisoner the opportunity to have a real reintegration course, which is not the case today.

"My objective is to guarantee the collective dynamic and not to weaken my political family", affirms Rachida Dati./LP/Olivier Corsan

On the penal reform, it is a question of limiting the preliminary investigations to two years

(Editor's note: during which the accused persons do not have access to their file)

.

Is this a good thing?

Limiting preliminary inquiries in time, and being able to extend them by reasoned decision, is a good principle in a rule of law.

But it should be noted that preliminary investigations are often longer and longer due to the complexity of cases and criminal proceedings, but also to the lack of specialized investigators.

We did not hear you on the conviction of Nicolas Sarkozy, to which you are nevertheless close.

Why ?

I remain loyal to Nicolas Sarkozy whose integrity I cannot question.

I did not speak last week because I believe that we must maintain serenity and moderation in this type of debate.

Nicolas Sarkozy is he right to denounce a judicial harassment?

Everyone says that we should not comment on a court decision.

It's a bit easy to move around

, there is nothing to see

.

We can comment on the procedure that led to the court decision and everyone agrees that this procedure was punctuated by many peculiarities: an investigation lasting more than six years, a secret investigation that has never been paid. to the debate, an investigation which was ordered by the Minister of Justice and the Prime Minister against the three magistrates of the National Financial Prosecutor's Office (PNF) at the origin of this investigation, and the wiretapping of a chief of opposition for months.

Nicolas Sarkozy has definitively closed the door to a candidacy in 2022. Who is the best candidate on the right?

Today, there is no evidence.

What is certain is that we must carry our values, even if the presidential election will not really begin until after the regional ones.

I have no doubts that the right will come out of it strengthened as in previous polls.

And, I tell my friends, let's not fall into the trap of Emmanuel Macron, who understood that France is mainly on our values, and wants to divide us to weaken us.

Do you imagine that Nicolas Sarkozy could support a candidate other than that of the right in 2022?

I can't imagine it.

For 2022, you have said several times that you want to play a role.

Where are you ?

I am more determined than ever with regard to a totally dislocated France.

By being a candidate?

Anyone can be a candidate.

My objective is to guarantee the collective dynamic and not to weaken my political family.

In the event of a Macron-Le Pen duel, are you in favor of the ni-ni position?

We must stop installing this duel in the media that the French do not want.

Be careful, by dint of persisting, the risk is great of aggravating the mistrust of the French vis-à-vis politicians and ultimately discouraging them from voting.

I like politics too much, it is the French who will decide.

Why did you launch a platform for young people La France belongs to you?

It is said that a whole youth no longer feels integrated into France.

I don't think she rejects France, but she no longer finds her place in a common destiny.

You have to hear this anger.

And I say it forcefully, it is better to channel it politically and democratically rather than let the anti-republicans turn it against the Republic.
