Because of a debt brake, Baden-Württemberg is generally not allowed to take out loans.
There is, however, an exception for natural disasters.
The state parliament with a green-black majority then classified the corona pandemic as such a catastrophe in October 2020.
The state parliament was able to pass a second supplementary budget with billions in new debt.
Now the AfD parliamentary group in Baden-Württemberg is taking action before the constitutional court for the state of Baden-Württemberg because of the green-black debt trick against the state parliament and the state government.
In its lawsuit, the AfD objects to legislative resolutions of October 14th, which it believes violate the state parliament's budget law.
The court confirmed receipt of the lawsuit.
In a first step, the state government and the state parliament should be given the opportunity to comment on the application.
There is no "right to create a disaster," said a spokesman for the AfD parliamentary group of the dpa news agency.
With the supplementary budget, the constitution was endangered and violated.
In addition, the AfD complains that the funds are misappropriated.
With an interim order, the parliamentary group wants to ensure that the country does not take on any further debts.
New borrowing should benefit small businesses
With the new debt, Baden-Württemberg wanted to support small and medium-sized companies with uncomplicated financial aid so that they do not have to file for bankruptcy in the Corona crisis.
To this end, the state has taken out loans amounting to five billion euros in order to be able to quickly and unbureaucratically grant affected entrepreneurs direct aid.
At short notice, the Greens, CDU, SPD and FDP jointly introduced the draft law for the rescue package for companies to the state parliament.
In a special meeting, a decision was made both on the expanded budget and on how to treat the corona crisis as a disaster.
