The defendant Ye Juncheng (20 years old) was charged with participating in the riot on Hennessy Road in Causeway Bay near Sogo Department Store on August 31, 2019, along with other unidentified people.

About 300 people gathered that day

Judge Yao Xunzhi said in his ruling that about 300 people blocked roads and erected roadblocks outside Sogo Department Store in Causeway Bay at the time of the case. Some people threw petrol bombs at the police. This was undoubtedly an illegal assembly and constituted a riot, but he questioned whether the defendant was involved.

A policeman said he saw two people throwing petrol bombs

A police officer who gave evidence in court said that he saw four people gather, including the defendant. Two of them threw a petrol bomb at the police officer. Four people turned around and fled.

The defendant was arrested at about 8 pm, and a helmet, goggles and gas mask were found on his body.

The live film failed to support the claim

The judge pointed out that the police officer’s observation could not be supported by the video clip, and another police officer who assisted in subduing the defendant did not see any gasoline bombs being thrown. It was difficult to trust the police officer completely and securely. The proof was able to reach an unreasonable point of doubt, so the defendant was ruled not guilty of riot.

16 people arrested that day, only 1 convicted

On the day of the incident, 16 people were charged with riot crimes. The other two cases involved 8 people and 7 people respectively. In the first case, 8 people were found not guilty. In the second case, one person was convicted and sentenced to prison. year.

Together with the defendant in this case, only one of the 16 people arrested that day was guilty.

The Department of Justice has requested the Court of Appeal for review in related cases.
