An emergency doctor was found guilty on Tuesday March 9 of manslaughter by the Ajaccio correctional court and sentenced to 4 months in prison and a 1000 euros fine after the death in 2011 of a young woman from an embolism pulmonary undiagnosed.

The Ajaccio hospital, which was also prosecuted and against which a fine of 25,000 euros had been requested in December during the trial, has, for its part, been acquitted.

Six months suspended prison sentence and 5,000 euros had been required against the 69-year-old emergency physician now retired.

The doctor is accused of "

not having been able to identify the symptoms of a pulmonary embolism

" and at the hospital "

a lack of access to medical files

", explained the president of the court by opening the trial.

Four medical reports were presented at the hearing and all concluded to a misdiagnosis.

On August 3, 2011, the 25-year-old victim presented to the emergency room of Ajaccio hospital for discomfort.

The emergency physician who had examined her had diagnosed her with Bouveret's tachycardia, before letting her go home.

The young woman's condition then deteriorated to the point of her death on August 5, 2011, from a pulmonary embolism.

During the trial, the doctor explained that he did not have access to the medical file of his patient who had been treated two months earlier at the hospital for acute pain in the leg, with a suspicion of phlebitis.

It was for this element that the hospital was also being sued.

In his requisitions, the prosecutor had described "

a man who made mistakes and served medicine in a devoted manner

", ensuring "to

measure the suffering which is his

".

He had nevertheless concluded with a serious fault, arguing that the link between this fault and the death of the young woman "

is consensus, nobody disputes it

".

Contacted by AFP, the lawyer for the emergency physician, Me Don-Georges Pintrel, who had pleaded for acquittal, indicated that his client "

was going to think about appealing to defend his honor.

He has not yet made his decision because he is tired from eleven years of proceedings

”.
