The Haifa District Court today (Thursday) accepted the state's appeal and convicted the actor Moshe Ivgi of all the sexual offenses attributed to him in the original indictment.

This, after Justices Avraham Elyakim, Erez Porat and Tamar Neot Perry discussed appeals filed by the Haifa District Attorney and Ivgi's lawyer, Michael Carmel, against Judge Ziv Arieli's ruling in the City Magistrate's Court in January last year in which Ivgi was accused of two indecent acts on a woman who worked with him. 2012.

As part of the affair that was exposed in Walla !, and in the sentence imposed on him in July, Ivgi was sentenced to six months of community service, six months of probation and compensation to the same woman in the amount of ten thousand shekels.

This is after he was acquitted due to doubt of two charges of indecent acts and sexual harassment by two other complainants.

In the case of another complainant, the prosecution withdrew from the charge during the trial.

This means that the case in Ivgi's case returns to the Magistrate's Court, which will sentence him, after arguments for a sentence are heard again.

In the previous trial that ended in a conviction for two indecent acts on one woman, the prosecution demanded 15 months in prison.

In answer to the Walla!

Prosecutors Mia Ozbagi, Orly Rosenthal and Hila Katz said that "there are new offenses now and naturally our position will be more difficult."

The first incident in which actor 67 Ivgi, 67, was convicted took place in August 2012, in which Ivgi participated in the filming of a film held at a studio in Bat Yam together with complainant A., who is 30 years younger than him.

According to the verdict, one day during the filming, when A. was sitting in the coffee corner, Ivgi approached her from behind, and stroked her under her shirt without warning.

Asked about his actions, he replied: "The loophole calls for a thief."

In the second incident, during the filming of a TV series later that year, Ivgi clung to A., hugged her tightly and whispered things in her ear.

In the sentence, Judge Ziv Arieli wrote that Ivgi "failed to set boundaries for himself, respect others, and allow 'junior' employees a protected and safe personal space. This, while taking advantage of his senior position in productions and filming, and understanding or expecting that the offense was violated. In view of the damage to it. "

"Ivy failed to set boundaries for himself."

He added that one might speculate and understand that he felt there was a "sense of freedom in the film and theater industry", but stressed that "the senior status of the accused in the entertainment industry does not justify or allow sending hands, caresses, sexual remarks, sexual hugs, lewdness".

Ivgi himself claims his innocence all the way, and his lawyer Michael Carmel expressed his intention to appeal as soon as the verdict was given and promised "to appeal Ivgi's wrongful conviction and fight for his acquittal of all guilt."

Indeed, immediately after the sentencing, he appealed both his conviction and the sentence imposed on him, seeking to submit "new evidence" and to summon some of the witnesses in which complainant A.

He said: "In accordance with developments that occurred after the sentencing."

"Caresses, sexual remarks, sexual hugs, lewdness."

Various women's organizations were outraged at the lightness of the sentence, and the Haifa District Attorney's Office in the Magistrate's Court requested that Ivgi be sent to 15 months in prison and also appealed the actor's acquittal on the grounds that " "Absolutely."

The decision to file the appeal was made by the Acting State Attorney, Adv. Amit Isman.

According to the state, Judge Ziv Arieli's decision was wrong, both in that he did not base the conviction based on the credibility of each of the complainants, and in the fact that he carefully examined each charge on his own but refrained from examining the overall picture.

"The State believes that a comprehensive examination of the women's testimonies and all the evidence submitted in the case, and the court's rulings regarding them, necessitated the conclusion that Ivgi should be convicted of the charges against him in the indictment," she argued.
