aggravated murder attempt

" in 2015 of a forty-something.

Mohamed Ainaoui and Bilal Belgherbi, aged 19 and 20 at the time of the facts, were found guilty of having, on the night of May 27 to 28, 2015, brutally beaten a father who came to look for his dogs in their city. de Libercourt (Pas-de-Calais), before burning his car in a field in Phalempin (North).

Taken out of the safe at the last minute by one of the accused, Fabien Lherbier was found a few meters away, naked, second-degree burnt on 20% of the body and almost dead.

He remained 66% disabled and partially lost his memory, especially that night.

All week, as since the start of the investigation, the two cousins ​​have denied the facts.

The Court followed the requisitions of the prosecution.

She sentenced Mohamed Ainaoui, described Thursday by the Advocate General as "

the leader

" and "

the most dangerous

", to 20 years of criminal imprisonment.

According to the prosecution, based largely on the confession of the third man, Mr. Ainaoui had struck the first blows, before being joined by his cousin and both of them "

hounded the victim

" with kicks. and fist.

"He

was a caïd

", the "

king of the district

", and when he met Mr. Lherbier on his territory "

he massacred him free of charge

", had reproached the Advocate General on Thursday, seeing in it a "

desire to destroy

”.

Bilal Belgherbi, found guilty of having "

smashed a bottle on the head

" of the forty-something and of having followed his cousin in this outburst of violence, was sentenced to 15 years.

The third defendant, Mohamed Boumaaraf, aged 22 at the time of the facts, was sentenced to five years in prison, four of which were suspended, for having made himself an accomplice by going in particular to fill a can of gasoline.

Arrested thanks to the video surveillance of a gas station, he had told the investigators everything.

He claims to have stumbled upon the cousins, known for their violence, by chance, then to have been "

forced

" to fetch gasoline and accompany them to Phalempin.

He was subjected to fear

", noted the Advocate General Thursday, considering that this young person had neither taken part in physical violence nor intended to kill.
