The Tel Aviv District Attorney's Office announced today (Wednesday) the families of Dean Shoshani and Stav Harari, who drowned in an elevator in the parking lot of their home in January 2020, about closing the case in their case.

The prosecution said that "after examining all the evidence in the investigation file, it was decided to close it, as no person, entity or authority was found to whom negligence could be attributed at the threshold required in the criminal trial, which led to their death."



Shoshani and Harari, 25, drowned in the building where they lived in the Hatikva neighborhood of Tel Aviv.

The two got stuck in an elevator, after the one that was trapped in the parking lot of the building underground and was rescued by firefighters lifeless.

As part of the police investigation, messages were collected, expert opinions were received in various fields and numerous inspection reports.

The State Attorney's Office stated that "after an in-depth investigation and after a careful examination of the findings of the investigation, the State Attorney's Office came to the conclusion that no indication of failure or negligence was found in the aspects examined."

It was further stated that "the expert opinion that examined the design of the building and the manner of its execution, did not raise any defects or failures in the building or in the parking lot. A similar conclusion emerges from testimonies given by the building owner and the professionals who designed and built the building."



In addition, the elevator technician of the elevator company who installed the elevator in the building and is responsible for its day-to-day integrity was questioned, and an expert opinion was obtained regarding the routine and emergency operation of the elevator and the mandatory safety standards in elevators in Israel.

Also according to this opinion, no failure or negligence was found in the conduct of the elevator company or anyone on its behalf.

The investigation will also examine the functioning of the rescue forces and the manner in which they were reported.

The State Attorney's Office added that "the weather forecast sent to the security and rescue forces on the day of the incident predicted an amount of precipitation between 35-50 mm of rain per day in Tel Aviv.

In practice, the amount of 100 mm per hour was measured in the afternoon. Due to the unusual weather that day, thousands of inquiries were received at the security and rescue forces' centers and all forces engaged in life-saving incidents. Due to these exceptional data and the complexity of the rescue on the day of the incident, "The tragic result could have been prevented, and an indictment could have been filed for causing death by negligence."
