Supreme Court: Moro was partial in sentencing Lula da Silva

Brazil's Federal Supreme Court ruled on Tuesday that former judge Sergio Moro acted partially when he convicted Lula da Silva.

The Federal Supreme Court of Brazil ruled on Tuesday that former judge Sergio Moro acted partially when he convicted former President Lula da Silva in connection with the purchase of a triplex apartment in the São Paulo city of Guarujá.

The decision comes after a lawsuit filed by Da Silva against Moro, whom he accused of irregularities in a corruption trial.

Three of the five members of the highest court considered that Moro had acted partially in a process that was followed by the former president for the acquisition of the home.

The role of Carmen Lúcia Antunes in the opinion on Moro and the sentence of Lula

Minister Carmen Lúcia Antunes Rocha had decided differently in 2018. However, now she reconsidered her opinion and agreed with the appeal filed by Lula da Silva's lawyers because there was “spectacularity in the case and a break in the impartiality” of Moro .

Federal Supreme Court Minister Edson Fachin had already overturned the conviction against the former president on March 8.

However, the new opinion of three votes against two adds Moro's suspension.

Former judge Moro has not ruled on Tuesday's ruling, nor did he after the resolution signed by Fachin.

Da Silva's defense, for its part, claimed that Moro's conviction, which was also upheld by an appeals court, had caused him "irreparable" damage, given that he spent 580 days in prison.

The case of the apartment on the beach will have to be tried again from scratch by a court with jurisdiction in Brasilia, as Minister Fachin had already decided.

However, this Tuesday's ruling does not automatically suspend all the proceedings against Da Silva, since some of the cases against him were not initiated by Moro.
