Unauthorized cutting of trees cost the perpetrator in Baldham near Vaterstetten a severe penalty.

And he also had to replant.

Baldham

- The excitement was big a year ago.

The headline of the Ebersberger Zeitung at the time was “Kahlschlag im Baldham's villa district”.

It was about a tree felling action in Erika-Köth-Straße.

As the town hall has now announced, the person primarily responsible has to pay a fine in the mid five-digit range.

The company that carried it out has now also accepted its fine.

New trees had to be planted on the approximately 10,000 square meter property.

And there is an official appeal to avoid such cases in the future.

Cut down 59 protected trees

One thing is clear: According to the Vaterstetten town hall, 59 trees were removed from the area that were protected by the local tree protection ordinance due to their size.

There was evidence and interviews with witnesses.

Neighbors had called the police at the time.

According to the town hall, the facts are "now beyond doubt" as follows: The property owner had the felling action carried out in order to comply with his duty of safety towards the neighbors.

A few days before the felling, spruce trees were repeatedly thrown onto streets and neighboring gardens during storms, which led to damage to a fence and a gas tank.

Admitted guilt and replanted 36 "high quality deciduous trees"

The property owner admitted his guilt and declared his willingness to replant, which has since been carried out.

For a five-figure sum, a total of 36 high-quality deciduous trees with a trunk circumference between 14 and 16 cm were replanted on the property instead of the felled conifers.

The suspicion expressed in the media that additional building rights should be created with the illegal felling was incorrect, emphasizes the town hall.

The admission of guilt, the duty to maintain safety, the replanting and the fact that there was no intention to obtain building permits "meant that the range of fines was not fully exhausted," according to the town hall.

The whole incident was very annoying for everyone involved and tied up a lot of time, energy and money.

The authority now says: “The administration therefore appeals to all those who are planning to change or cut down a protected tree in the municipality to obtain approval in advance from the Environment Agency.

The companies involved in tree felling are also responsible for finding out about local protective regulations and for having written approval from the property owner. "
