Moshe Levy, 56, an electric bicycle rider who was convicted of causing the death by negligence of an elderly man, was sentenced to four months of community service this morning (Thursday).
In addition, in addition to service work, the judge sentenced him to six months probation, revocation of a driver's license for five years and compensation of NIS 4,000 to the family of the deceased.
It is important to note that Levy is the first person in Israel, and so far the only one, to be convicted of this offense while riding an electric bicycle.
According to the charges, on October 16, 2017, around 11:30 a.m., Levy was riding an electric bicycle on Rambam Street, Hadera, at a speed of 24 km / h.
At the time, 88-year-old Piotr Alfayev was standing on the curb and began crossing the road at the intersection of Rambam and Lezovsky streets from east to west.
The indictment states that "after the deceased crossed a distance of about two meters at the crossing, and although the defendant could and should have noticed him, he continued to ride continuously, did not slow down his riding speed and hit with the bicycle the deceased, who fell and was injured.
"As a result, the deceased was injured and suffered skull fractures and cerebral hemorrhage. On November 1, 2017, the deceased died during his hospitalization, as a result of his deteriorating condition due to his accidental injury."
In the verdict handed down last month, Judge Alex Achter ruled in his decision in which he convicted Levy: "After reviewing all the evidence before the court, I have no reasonable doubt left in my heart as to the defendant's responsibility."
