After both sentences were not sentenced to prison
Defendant Zhu Peiheng (20 years old, student) pleaded guilty to criminal damage in the Magistrates' Court, accusing him of damaging the glass wall belonging to Ho Junyao's office in Tsuen Fung Centre on July 22, 2019.
The trial magistrate Wen Shaoming sentenced him to a 12-month probation order. The Attorney General then applied for a review of the sentence in the Magistrates’ Court. The Court of Justice changed the sentence to a 200-hour social service order for the defendant. However, the Attorney General still considered it too light and applied to the High Court for a review.
The representative of the Department of Justice pointed out that the footage showed that the defendant hit the glass wall with a metal object for more than 9 times, which lasted more than 1 minute. He believed that he committed the crime on impulse, and said frankly that many of these gatherings were peaceful at first, but some people affected the atmosphere of the scene.
The prosecution accused the defendant of targeting politicians
The representative of the Department of Justice also pointed out that there were a number of additional penalties in this case. The location involved was the Legislative Council Member’s office, reflecting that the defendant targeted politicians, and the office had to be renovated for several months afterwards and could not serve the residents. The office also had difficulties in buying insurance.
In addition, the case involved other comrades. After the defendant was sentenced to a probation order, he was arrested for participating in the Kowloon parade. However, he "kicked the security" in the case and has not been charged for the time being.
The defendant apologized to He Junyao
The defendant’s lawyer stated that the defendant suffered from hyperactivity and Astrogen’s disease and was easily affected. After the incident, his mother was found to have cancer, but the judge of the Court of Appeal stated that he knew how to apologize to He Junyao afterwards and questioned the severity of his condition. .
A judge of the Court of Appeal also questioned that the defendant’s attire was not only for defense, but the defendant’s lawyer clarified that the studs on his armguards were not nails, and the gloves were only football gloves, and the equipment was given by others on the scene.
The Court of Appeal finally found that the magistrate's principle was wrong, and the sentence was obviously too light. The sentence was revoked by the social service order and the defendant was sentenced only after obtaining reports from the training center, detention center, and rehabilitation center.
