Union sues ADP to suspend job protection plan

2021-03-31T11:19:43.315Z

The Unsa-Sapap accuses ADP of initiating this plan after having signed an agreement at the beginning of the year with the trade unions to lead a collective contractual rupture.

Unsa-Sapap has taken Paris Airport (ADP) to court to suspend a job protection plan (PSE) initiated by management while 1,150 departures are already scheduled for 2021, the union announced on Wednesday.

He indicated that he had launched an “

emergency summary procedure

” in order to request the suspension “

throughout 2021 of the work contract adaptation plan (PACT) and the related employment safeguard plan

”.

ADP wants to reduce its payroll by removing certain bonuses, which would lead to wage cuts ranging from 4 to 8%, says management.

The unions estimate a shortfall of up to 15 or 20% of the salary for some employees.

At the same time, ADP is preparing a job protection plan for all employees who refuse to modify their employment contract.

The Unsa-Sapap, like the CGT, refuses to negotiate with the management the conditions of this PES.

She criticizes ADP in particular for having signed an agreement at the beginning of the year with the trade unions for a collective termination of agreement (RCC) providing for 1150 voluntary departures, of which 700 will not be replaced in 2021. “

This system is not compatible with redundancies for economic reasons

”, which is a PES, insists the union.

If an employee declines the opportunity to leave within the framework of the RCC, he can still be dismissed in the event of refusal of a reduction in his salary.

"

Under these conditions, collective contractual termination is no longer conventional, but applies under the outright threat of dismissal,

" laments Unsa.

The union therefore calls for the suspension of the PACT project and the PSE procedure, as long as voluntary departures have not taken place, "

either throughout the year 2021

".

"

We will see what will happen in 2022, the consequences of the vaccine, the establishment of a health passport and if the aviation sector is finally taking off again

", wants to believe Laurent Garssine, secretary general of the UNESCO Sapap.

The hearing is set for April 14 at the Bobigny judicial court.
