Some netizens called for "Sing with you" in various shopping malls in May last year. A 16-year-old boy was involved in the destruction of the mainland beverage shop "Hey Tea" in Shatin New Town Plaza.

He earlier pleaded guilty to criminal damage and was sentenced to a 200-hour social service order.

The Court of Appeal found that the sentence was too light, revoked the original sentence, and asked for multiple reports before considering the sentence.

The case was originally scheduled to be processed today (1st), but the latest report stated that the teenager had asthma and was not physically fit to enter the labor camp. However, at the time of the original trial, not only did he not mention that he had been ill, but that he had performed well in sports.

The lawyer explained that the physical condition deteriorated due to the exercises related to the epidemic.

The Court of Appeal finally decided to get the report again and adjourned the case until the 16th of this month.

The 17-year-old defendant, surnamed Zhou, earlier admitted that on May 13 last year, he destroyed the facilities of Hey Tea at the Sha Tin New Town Plaza.

He was originally sentenced to a 200-hour social service order. Last month, the Court of Appeal accused the trial magistrate that he had made a mistake in principle, revoked the sentence, and requested reports on his behalf from the training center, the detention center, and the rehabilitation center.

Several teenagers tortured and destroyed the Xicha shop in the New Town Square.

Said to reduce exercise due to the epidemic

When the Court of Appeal dealt with the case today, Judge Peng Weichang stated that the latest report obtained mentioned that the defendant had asthma since he was a child and his physical condition was not suitable for entering the reeducation center. The report obtained at the original trial did not mention it.

Judge Pan Minqi described the content of the report as a "180-degree change." The earlier report referred to the defendant's outstanding performance in sports. He played football. Between 2016 and 2019, he won the championship by running.

The defendant’s lawyer asked for instructions explaining that his physical condition had deteriorated due to the reduction in physical activity due to the epidemic.

The defendant wants to provide information about the diagnosis of asthma

After consideration, the Court of Appeal decided to obtain the defendant’s training center, detention center, and rehabilitation center reports, and instructed the defendant to submit a medical certificate describing the defendant’s asthma and his last medical consultation.

Case Number: CAAR1/2021

The Department of Justice requested a review of the sentence in a case related to the legislative amendment movement.
