What democratic problems pose the postponement of local elections?

INTERVIEW - For Benjamin Morel, lecturer in public law at the University of Paris II-Panthéon-Assas, the possible postponement to the fall or even after the presidential election of regional and departmental elections does not legally hold and involves a democratic risk .

- Voters are called to the polls on June 13 and 20 to renew regional and departmental councils.

But the elections could be postponed due to health risk.

What would be the consequences?

-There is first a legal question.

As such, a distinction must be made between regional and departmental elections.

The previous regional ones were held in December 2015. The postponement until the autumn would therefore not lead to an undue extension of the mandate of the regional elected representatives.

On the other hand, the 2015 departmental events took place in March.

However, the elections must be held at a regular pace, unless there is an imperative of general interest.

A postponement to the fall for the departmental departments would therefore imply showing that it is impossible to ensure the vote in June and that the fall is more favorable.

It is far from obvious.
