Walter Kohl is said to have filed a lawsuit against Federal Health Minister Jens Spahn at the Bonn Regional Court.
The son of the former Chancellor Helmut Kohl demands 5.48 million euros.
This is reported by the "Bild" newspaper.
Last spring, Kohl took part in the Ministry of Health's tender for mask delivery through his company Kohl Consult.
In addition to other companies, Kohl's were also awarded the contract.
According to the information, Kohl Consult was supposed to deliver one million FFP2 masks for 4.50 euros on May 8th.
According to his statement, Kohl was personally present at the delivery and waited twelve hours, as the "Bild" writes.
However, the trucks were not allowed to unload because of a capacity bottleneck.
The delivery took place three days later.
However, Kohl Consult never received the amount due.
Spahn's ministry suddenly claimed that the masks were not water-repellent, Kohl said.
But Spahn didn't order that either.
“I don't understand why Jens Spahn and his ministry deliberately break their own contracts.
The principle that contracts are to be kept does not seem to apply to either of them, ”Kohl told the newspaper.
According to the contract that "Bild" is supposed to have with us, payment should be made seven days after delivery.
Without checking the goods - as allegedly in the contracts with other suppliers.
A Spahn spokesman said in response to an "Bild" request: "We will not comment on the details of ongoing proceedings."
