The complaint filed by a Palestinian detainee regarding an invasive physical search conducted on her body as part of a joint operation by the IDF and the GSS in 2015 was closed today (Wednesday) by the Deputy State Attorney, Nurit Littman, due to lack of evidence.

Littman's decision, which adopted the recommendations of the Tel Aviv District Attorney's Office and the Department of Police Investigations at the State Attorney's Office, was made after a joint investigation by DIP and MPI.

She recommended that the head of the GSS take appropriate command action in the case of two of the service personnel.

The incident in respect of which the complaint was filed occurred during a search of the home of a detainee, a resident of Judea and Samaria, whose search, carried out by two female soldiers (one of them a doctor), was carried out due to a particular operational need and material injury to her dignity and privacy.

Following the detention of the detainee and after the MPC's investigation into the matter, the State Attorney adopted the recommendation of the GSS Investigator Complaints Complainant, and ordered the opening of a criminal investigation and the establishment of a DIP (which has the authority to investigate GSS members) and MPC.

After examining the findings of the investigation and weighing all the relevant considerations, and after a number of additional investigative actions were performed as part of the investigation, it was found that there is a lack of evidence, including the source of the search, the software and the circumstances.

Because there was not enough evidence on the subject, those involved in this incident could not be prosecuted, neither in a criminal proceeding nor in a disciplinary proceeding.

However, the investigation clarified that although there was no intention to harm the Palestinian detainee, "the conduct of those involved in the affair does not meet the standard expected and required of them," according to the sub-statement.

Against the background of this conclusion, the Deputy State Attorney considered that this was a serious incident that could not be left without proper treatment, and therefore she ordered that her decision be forwarded to the GSS chief, in order to consider taking appropriate command measures against two involved service personnel. Lessons are being committed for the future, "it was stated. The sub-announcement also stated that a commanding procedure was initiated against a third GSS member as early as 2019 for his conduct in the incident.
