The son of a boss from the Banfield bar killed his best friend and is free

Joaquin left for a few minutes.

For his brothers it was no more than 10 or 15. At the door, a car and a group of friends from Villa Niza, a neighborhood of Banfield, south of the GBA, located behind the Courts of Lomas de Zamora.

It all happened in Pasaje Merlino 1946, when Miguel Ramón Tuñinali (19) parked in front of the house of his friend, Joaquín Castillo (18).

After a few seconds of confusion, they tried to revive Joaquín while Tuñinali tried to run away to avoid being held.


"They said he was in shock. But

he was not so shocked

because he had time to take the gun and gather the scabbard. He was never imprisoned, not a single day. What no one can explain to us is

how you can kill someone and not go to the jail,

"exclaimed Gabriela Castillo (35), one of Joaquín's ten sisters.

After hearing the shot, another of the victim's brothers looked out onto the sidewalk and found him wounded.

The young man died on the way to the Fiorito Prompt Attention Unit (UPA 24 hs.).

Joaquín Castillo would have turned 19 on December 24.

His best friend shot him in the chest three days earlier.

The truth is that the case entered a judicial labyrinth that ended with the freedom of the accused and the anguish of the family.

First, the prosecutor Lorenzo Latorre described the crime as "

manslaughter

" (punishable by six months to three years in prison).

It was based on the account of Miguel Tuñinali, who said that it had been

"an accident"

and that the shooting was unintentional.

Shortly after, and with the testimony of witnesses, he changed the accusation to "

simple homicide

" (it includes a penalty ranging from 8 to 25 years in prison).

"Later, when they denied him the exemption from prison, the lawyer of this person appealed and the Chamber agreed with the prosecutor, it remained as simple homicide. But, when they finally asked for the arrest, the Court of guarantees refused and

changed it again to wrongful death

. Now we have to keep waiting until the appeals are resolved again but, in the meantime,

this person is still free,

"warned Mariela Castillo (37), another sister of the victim.

"What I want is to know what happened to my brother because this person killed him and he has to go to jail," he insisted.

This Wednesday they carry out a new demonstration, from the place of the event to the Courts of Lomas de Zamora, to ask that they resolve the situation and arrest the accused.

"He committed a homicide. If it was simple or guilty, the Justice has to solve it, but he has to go to jail.

According to the victim's family, they receive intimidation on social networks, in the marches they organize and also at the door of the house where Joaquín's brothers live.

They are afraid because the young man

is the son of Miguel Ángel "Miguelito" Tuñinali (42), leader of the Banfield brave gang

, known as "La Banda de Miguel" or "La Banda del Sur".

The boss of the Banfield bar, "Miguelito" Tuñinali, was arrested in 2018 along with his mother, "La Nancy" Burgos.

His father ended up imprisoned in 2018 after 18 raids in Lomas de Zamora in an investigation by the prosecutor Pablo Rossi and the judge of Guarantees Gabriel Vitale.

There also fell the mother of "Miguelito", Nancy Azucena Burgos, better known as "La Nancy", now 59 years old, and her second, Gastón "Pelado" Aralda, 47.

They arrested him along with eight people and accused him of illicit association.

multiple criminal cases against him.
