Infection Protection Act: These nationwide corona measures are in the draft law

The federal government wants to take action with an "emergency brake law" - and lay down new uniform rules for the states. The draft has been submitted to SPIEGEL. In addition to curfews, there are also school closings.

No new federal-state round - but an expansion of the Infection Protection Act: Chancellor Angela Merkel (CDU) agreed with the chairman of the Prime Minister's Conference (MPK), Berlin's Prime Minister Michael Müller (SPD) and his deputy, Bavaria's Prime Minister Markus Söder (CSU) agreed.

Soon there will be nationwide regulations that apply in all districts.

The corresponding draft law is to be passed through the Bundestag and Bundesrat as quickly as possible, and SPIEGEL has the paper.

"There is a very dynamic and serious situation throughout Germany with a sharp increase in the number of cases within a few days," says the draft.

The government is essentially planning an “Emergency Brakes Act”, which will introduce binding nationwide measures from a seven-day incidence of 100.

In addition, the government is authorized to issue statutory ordinances with the consent of the Federal Council for the uniform determination of corona measures.

In this way, the federal government is given the same options for action as the federal states have been up to now.

In contrast to the resolutions from the previous Bund-Länder rounds, the Länder are therefore obliged by law to implement what has been decided.

Curfews, contact restrictions, shop closings

Specifically, measures should take effect if a district or an independent city has an incidence of 100 newly infected per 100,000 inhabitants on three consecutive days.

If it is below 100 for three consecutive days, the emergency brake is deactivated.

The following restrictions should apply:

  • Private gatherings are limited to members of the household and one additional person - per day.

    The group cannot exceed five people in total, not including children under 14 years of age.

  • A curfew should apply from 9 p.m. to 5 a.m.

  • Restaurants, cafés and company canteens must remain closed.

    However, the serving and delivery of food remains permitted.

  • Leisure facilities such as swimming pools, amusement parks, discos and saunas will be closed.

    Zoos, theaters, operas, cinemas and museums also have to close.

  • Employers should make it possible to work from home whenever possible.

  • The opening of shops and handicrafts offers is prohibited, with the exception of grocery stores, pharmacies, drug stores and petrol stations.

  • Tourist overnight stays are prohibited.

  • Exercising is also prohibited - unless you train alone, in pairs or members of your own household.

    Professional sport may take place to the exclusion of spectators.

In addition, face-to-face teaching in schools and universities is to be prohibited, albeit with an incidence of 200.

Exceptions should apply to everyone who has a negative corona test no longer than 36 hours ago.

What the draft law explicitly does not want to restrict: freedom of assembly and religious gatherings.

So it should be allowed to meet for demonstrations, regardless of the contact restrictions.

However, municipalities still have the authority to approve or reject a demonstration.

The new law is to be passed by the cabinet in the coming week.

Its meeting will be brought forward from Wednesday to Tuesday.

Then the Bundestag has to pass it in the following days.

And finally, the Federal Council must also give the green light in a specially convened special session - if the majority of the states play along.

Their next regular meeting is only on May 7th.
