Two Königsdorf families are among the first representatives.

They have planted their property along the street on Laurenziweg / Dekan-Zistl-Ring with not only some native plants, but also mainly thuja hedges - which is not allowed there according to the development plan.

In its most recent meeting, the municipal council dealt with the application for an exemption from this master plan.

In February, as part of its construction supervision, the district office had drawn the families' attention to the fact that indigenous woods such as hornbeam, cornel cherry or privet are to be planted in the current area of ​​the plan.

Two years earlier, the Königsdorf building authorities had advised the applicants that the planting had to comply with the green area.

In response to an email from the two families on June 5, 2019, in which they informed the municipality of their intention to vote for Thujen, the administration informed the applicants that this was not allowed - but not in writing, but only by telephone.

However, the client denies having been notified of his misconduct by telephone and refers to his email, which contains the following sentence: “Thank you again for the information that vertical wooden picket fences up to a height of 1.10 meters are used as fences are permitted and can be planted as a privacy screen. ”Now he thinks he is right.

Managing director Andreas Baumann sees an isolated exemption of the applicants from the development plan "to create lawful conditions" as a way to resolve the conflict, "as the basic features of the planning are not affected".

However, the possibility of setting a precedent is also not ruled out.

Thuja are not a habitat for insects

The pros and cons were also balanced in the committee.

Isabella Vogl (FWG) pointed out that thuja are poisonous and "neither a habitat for insects nor for birds" and only serve to seal off the outside.

"But we are here in Königsdorf and not in Grünwald." It is extremely unfortunate for Vogl - as for some of her fellow councilors - that the applicant was informed about his misconduct not in writing, but verbally.

Georg Stöckl (UBL) - in the committee meeting "strictly against the Thujos" - felt the situation due to the ominous, incomprehensible phone call "really difficult, I would therefore almost tend to decide now in the interests of the citizen".

Hans Hartl (CSU), on the other hand, spoke out in favor of a hard line in the Thujen discussion.

The applicant has already received many exemptions.

With 9: 7 votes, the committee decided to approve the isolated exemption from the development plan and thus the existing hedges.
